It is not lawful for you, (Men), to take back any of your gifts (from your wives), except when both parties fear that they would be unable to keep the limits ordained by Allah. If ye (judges) do indeed fear that they would be unable to keep the limits ordained by Allah, there is no blame on either of them if she give something for her freedom. These are the limits ordained by Allah; so do not transgress them if any do transgress the limits ordained by Allah, such persons wrong (Themselves as well as others).

But if ye enter houses, salute each other - a greeting of blessing and purity as from Allah. Thus does Allah make clear the signs to you: that ye may understand.

He that man is a hypocrite. Later that man heard what Muadh said about him; so he came to the Prophet and said; O Allah Messenger ﷺ ! We are people who work with our own hands and irrigate our farms with our camels. Last night Muadh led us in the night prayer and he recited Surat AlBaqara; so I offered my prayer separately; and because of that; he accused me of being a hypocrite. SahihAlBukhari-017-001-3178Narrated Saeed Bin Jubair: I asked Ibn Umar; What is the verdict if a man accuses his wife of illegal sexual intercourse? Ibn Umar said; The Prophet ﷺ separated by divorce the couple of Bani AlAjlan; and said; to them ; Allah knows that one of you two is a liar; so will one of you repent? But both of them refused. He again said; Allah knows that one of you two is a liar; so will one of you repent? But both of them refused. So he separated them by divorce. Ayoub ; a sub-narrator said: Amr Bin Dinar said to me; There is something else in this Hadith which you have not mentioned. It goes thus: The man said; What about my money i.e. the Mahr that I have given to my wife ? SahihMuslim-017-001-21197Ibn Shihab narrated about the invokers of curses and the practice of lian based on the authority of Sahl Bin Sad; of the tribe of Saida. that a person from the Ansar came to Allah Apostle ﷺ and said: Allah Messenger; tell me about the person who found a man with his wife. The remaining part of the hadith is the same but with this addition: They invoked curses in the Masjid and I was present there. And he narrated in the hadith: He divorced her with three pronouncements before Allah Messenger ﷺ commanded him to get separation. SahihMuslim-017-001-21198Saeed b Jubair reported: I was asked about the invokers of curses during the reign of mousab Bin AlZubair whether they could separate themselves by this process. He said: I did not understand what to say. So I went to the house of Ibn Umar Allah be pleased with them in Mecca. I said to his servant: Seek permission for Me. He said that he Ibn Umar had been taking rest. He Ibn Umar heard my voice. and said: Are you Ibn Jubair? I said: Yes. Hesaid: Come in. By Allah; it must be some great need which has brought you here at this Hour. So I got in and found him lying on a blanket reclining against a pillow stuffed with fibres of date-palm. I said: O AbuAbd AlRahman; should there be separation between the invokers of curses? He said: Hallowed be Allah; yes; The first one who asked about it was so and so. he said: Messenger of Allah; tell me If one of us finds his wife committing adultery: what should he do? If he talks; that is something great; and if he keeps quiet that is also something great which he cannot afford to do. Allah Prophet ﷺ kept quiet or some time. After some time he that very person came to him Allah Messenger and said: I have been involved in that very cage about which I had asked you Allah the Exalted and Majestic then revealed these verses of Surah Nur: Those who accuse their wives verse 6 ; and he the Holy Prophet recited them to him and admonished him; and exhorted him and informed him that the torment of the world is less painful than the torment of the Hereafter. He said: No; by Him Who sent you with Truth; I did not tell a lie against her. He the Holy Prophet then called her the wife of that person who had accused her and admonished her; and exhorted her; and informed her that the torment of this world is less painful than the torment of the Hereafter. She said: No; by Him Who sent thee with Truth; he is a liar. it was the man who started the swearing of oath and he swore in the name of Allah four times that he was among the truthful. and at the fifth turn he said: Let there be curse of Allah upon him if he were among the liars. Then the woman was called and she swore four times in the name of Allah that he her husband was among the liars; and at the fifth time she said : Let there be curse upon her if he were among the truthful. But we were afraid lest we should be separated from the Messenger of Allah. So I proceeded on with a view to seeking the Messenger of Allah ﷺ. Some- times Idashed my horse and sometimes I made it run at a leisurely pace keeping pace with others. In the meanwhile I met a person from Banfu Ghifar in the middle of the night. I said to him: Where did you meet the messenger of Allah ﷺ ? He said: I left him at Tabin and he intended to halt at Suqya to spend the afternoon. I met him and said: Messenger of Allah. your Companions convey salutations and benedictions of Allah to you and they fear that they may not be separated from you and the enemy may do harm to you ; so wait for them; and he the Holy Prophet waited for them. I said: Messenger of Allah; I killed a game and there is left with me some of the meat. The Apostle of Allah ﷺ said to his people: Eat it. SunanAlTermithi-017-001-10055Narrated Saeed Bin Jubair: I was asked about those who were involved in the case of Lian and if they are to be separated; during the leadership of mousab Bin AlZubair. I did not know what to say. So I went to the house of Abdullah Bin Umar and I sought permission to enter. I was told he was taking a nap; but he heard me taking and he said: Is it Ibn Jubair? Enter. You would not have come except for a need. He said: So I entered and found him laying on a saddlecloth from his mount. I said: O Abu Abdulrahman Are those involved in Lian separated? He said: Glorious is Allah! Yes. The first who asked about hat was so-and-so the son of so-and-so. He came to the Prophet ﷺ and said O Messenger of Allah! If one of us saw his wife committing adultery; what should he do? If he were to say anything; his statement would be a horrible matter; and if he were to remain silent; his silence about the matter would be horrible. He said: So the Prophet ﷺ remained silent and did not answer him. Afterwards he came to the Prophet ﷺ and said: The one who asked you about it has been tried by it. So Allah revealed these Ayat from Surat AlNur: And those who accuse their wives and have no witnesses except themselves; let the testimony of one of them be four testimonies by Allah 24:6-10 - until the end of those Ayat. He said: So he called for the man and recited the Ayat to him and admonished him; reminded him; and he told him: Indeed the punishment of the world is less than the punishment of the Hereafter. So he said: Nay! By the One Who sent you with the Truth! I did not lie about her. Then he ﷺ did the same with the woman; admonishing her and reminding her and he told her: Indeed the punishment of the world is less than the punishment of the Hereafter. She said: Nay! By the One Who sent you with the Truth! He is not telling the truth. He said: So he started with the man: He testified four times; by Allah that he is one of the truthful; and the fifth time that the curse of Allah be upon him if he was one of the liars. Then the same with the woman: She testified four times by Allah; that he was one of the liars; and the fifth time that the wrath of Allah be upon her if he was one of the truthful. SunanAlTermithi-017-001-7953Saeed Bin Jubair narrated: I was asked about those who were involved in the case of Lian and if they are to be separated; during the leadership of mousab Bin AlZubair. I did not know what to say. So I went to the house of Abdullah Bin Umar and I sought permission to enter. I was told that he was taking a nap; but he heard me talking and he said: Is it Ibn Jubair? Enter. You would not have come except for a need.He said: So I entered and found him lying on a saddlecloth from his mount. I said: O Abu Abdulrahman Are those involved in Lian separated? He said: Glorious is Allah! Yes. The first who asked about that was so-and-so the son of so-and-so. He came to the Prophet and said: O Messenger of Allah! If one of us saw his wife committing adultery what should he do? If he were to say anything; his statement would be a horrible matter; and if he were to remain silent; his silence about the matter would be horrible.He said: So the Prophet remained silent and did not answer him. Afterwards he came to the Prophet and said: The one who asked you about it has been tried by it. So Allah revealed these Ayat from Surat AlNur. And those who accuse their wives and have no witnesses except themselves - until the end of those Ayat. So he called for the man and recited the Ayat to him and admonished him; reminded him; and he told him: Indeed the punishment of the world is less than the punishment of the Hereafter. So he said: Nay! By the One Who sent you with the truth! I did not lie about her. Then he did the same with the woman; admonished her and reminding her and he told her: Indeed the punishment of the world is less than the punishment of the Hereafter. She said: Nay! By the One Who sent you with the truth! He is not telling the truth.He said: So he started with the man: He testified four times; by Allah that he is one of the truthful; and the fifth time that the curse of Allah be upon him if he was one of the liars. Then the same with the woman: She testified four times by Allah; that he was one of the liars; and the fifth time that the wrath of Allah be upon her if he was one of the truthful. Alaah has said And for those who fear Allaah; He ever prepares a way out. Since you did not keep duty to Allaah I do not find a way out for you. You disobeyed your Lord and your wife was separated from you. Allaah has said O Prophet! When you divorce women divorce them in the beginning of their waiting period.Abu Dawud said This tradition has been transmitted by Humaid AlAraj and by others from Mujahid on the authority of Ibn Abbas. Shubjh narrated it from Amr Bin Murrah from Said Bin Jubair on the authority of Ibn Abbas. Ayoub and Ibn Jubair both narrated it from Ikrimah Bin Khalid from Said Bin Jubair on the authority of Ibn Abbas. Ibn Juraij narrated it from Abd AlHamid Bin Rafi from Ata from Ibn Abbas. AlAmash narrated it from Malik Bin AlHarith on the authority of Ibn Abbas. They all said about the divorce by three pronouncements. He allowed it and said Your wife has been separated from you similar to the tradition narrated by Ismail from Ayoub from Abd Allaah Bin Kathir.Abu Dawud said Hammad Bin Zaid narrated it from Ayoub from Ikrimah on the authority of Ibn Abbas. This version adds If he said You are divorced three times saying in one pronouncement; it constitutes a single divorce. Ismail Bin Ibrahim narrated it from Ayoub from Ikrimah. This is his Ikrimahs statement. He did not mention the name of Ibn Abbas. SunanAbuDawoud-017-001-25164Narrated Abdullah Ibn Umar: The Messenger of Allah ﷺ wrote a letter about sadaqah zakat but he died before he could send it to his governors. He had kept it with his sword. So Abu Bakr acted upon it till he died; and then Umar acted upon it till he died. It contained: For five camels one goat is to be given; for ten camels two goats are to be given; for fifteen camels three goats are to be given; for twenty camels four goats are to be given; for twenty-five to thirty-five camels a camel in her second year is to be given. If the number exceeds by one up to seventy camels; a camel in her fourth year is to be given; if they exceed by one up to seventy-five camels; a camel in her fifth year is to be given; if they exceed by one up to ninety camels; two camels in their third year are to be given; if they exceed by one up to one hundred and twenty; two camels in their fourth year are to be given. If the camels are more than this; a camel in her fourth year is to be given for every fifty camels; and a camel in her third year is to be given for every forty camels. For forty to one hundred and twenty goats one goat is to be given; if they exceed by one up to two hundred; two goats are to be given. If they exceed by one up to three hundred; three goats are to be given; if the goats are more than this; one goat for every hundred goats is to be given. Nothing is payable until they reach one hundred. Those which are in one flock are not to be separated; and those which are in separate flocks are not be brought together from fear of sadaqah zakat. Regarding that which belongs to two partners; they can make claims for restitution from each other with equity. An old goat and a defective one are not to be accepted as sadaqah zakat. AlZuhri said: When the collector comes; the goats will be apportioned into three flocks: one containing bad; the second good; and the third moderate. The collector will take zakat from the moderate. The narrator Hilal asked: What is kawma; Abu Salih? He said: A camel a high hump. The narrator continued: He the collector refused to accept it. He said: I wish you could take the best of my camels. He refused to accept it. He then brought another camel lower in quality than the previous one. He refused to accept it too. He then brought another camel lower in quality than the previous one. The man refused to hand it over the horse to him. He said: Abu Barzah; the companion of the Prophet ﷺ ; is to decide between me and you. They went to Abu Barzah in the corner of the army. They related this story to him. He said: Do you agree that I make a decision between you on the basis of the decision of the Messenger of Allah ﷺ ? The Messenger of Allah ﷺ said: Both parties in a business transaction have an option right to annul it so long as they have not separated. A letter came to us from Umar one year before his death; saying: Kill every magician; separate the relatives of prohibited degrees from the Magians; and forbid them to murmur before eating. So we killed three magicians in one day; and separated from a Magian husband his wife of a prohibited degree according to the Book of Allah. He prepared abundant food and called them; and placed the sword on his thigh. They ate the food but did not murmur. They threw on the ground one or two mule-loads of silver. MuwataMalik-017-001-35223Yahya related to me from Malik from Nafic from Abdullah Ibn Umar that a man cursed his wife in the time of the Messenger of Allah; may Allah bless him and grant him peace; and disowned her child. The Messenger of Allah; may Allah bless him and grant him peace; separated them and gave the child to the woman. Malik said; Allah the Blessed; the Exalted; said; The testimony of men who accuse their wives but do not have any witnesses except themselves is to testify by Allah four times that he is being truthful; and a fifth time; that the curse of Allah will be upon him; if he should be a liar. She will avoid punishment if she testifies by Allah four times that he is a liar; and a fifth time; that the wrath of Allah shall be upon her; if he should be telling the truth. Surat 24 ayat 6. Malik said; The sunna with us is that those who curse each other are never to be remarried. If the man calls himself a liar; i.e. takes back his accusation ; he is flogged with the hadd-punishment; and the child is given to him; and his wife can never return to him. There is no doubt or dispute about this sunna among us. Malik said; If a man separates from his wife by an irrevocable divorce by which he cannot return to her; and then he denies the paternity of the child she is carrying; whilst she claims that he is the father; and it is possible by the timing; that he be so; he must curse her; and the child is not recognised as his. Malik said; That is what is done among us; and it is what I have heard from the people of knowledge. Malik said that a man who accused his wife after he had divorced her trebly while she was pregnant; and he had at first accepted being the father but then claimed that he had seen her committing adultery before he separated from her; was flogged with the hadd-punishment; and did not curse her. If he denied the paternity of her child after he had divorced her trebly; and he had not previously accepted it; then he cursed her. Malik said; This is what I have heard. Malik said; The slave is in the same position as the free man as regards making accusations and invoking mutual curses lian. He acts in the lian as the free man acts although there is no hadd applied for slandering a female-slave. Malik said; The muslim slave-girl and the christian and jewish free woman also do lian when a free muslim marries one of them and has intercourse with her. That is because Allah - may He be blessed and Exalted; said in His Book; As for those who accuse their wives; and they are their wives. This is what is done among us. Malik said that a man who did the lian with his wife; and then stopped and called himself a liar after one or two oaths and he had not cursed himself in the fifth one; had to be flogged with the hadd-punishment; but they did not have to be separated. Malik said that if a man divorced his wife and then after three months the woman said; I am pregnant; and he denied paternity; then he had to do lian. Malik said that the husband of a female slave who pronounced the lian on her and then bought her; was not to have intercourse with her; even if he owned her. The sunna which had been handed down about a couple who mutually cursed each other in the lian was that they were never to return to each other. MuwataMalik-017-001-35227Yahya related to me from Malik from Yahya Ibn Said that Bukayr Ibn Abdullah AlAshajj informed him that Muawiya Ibn Abi Ayash AlAnsari told him that he was sitting with Abdullah Ibn AlZubair and Aasi m Ibn Umar Ibn AlKhattab when Muhammad Ibn Iyas Ibn AlBukayr came up to them and said; A man from the desert has divorced his wife three times before consummating the marriage; what do you think? Abdullah Ibn AlZubair said This is something about which we have no statement. Go to Abdullah Ibn Abbas and Abu Huraira. I left them with Aisha. Ask them and then come and tell us. He went and asked them. Ibn Abbas said to Abu Huraira; Give an opinion; Abu Huraira! A difficult one has come to you. Abu Huraira said; One pronouncement separates her and three makes her haram until she has married another husband. Ibn Abbas said the like of that. MuwataMalik-017-001-35328Yahya related to me from Malik from more than one source that when Abdullah Ibn Masud was in Kufa; he was asked for an opinion about marrying the mother after marrying the daughter when the marriage with the daughter had not been consummated. He permitted it. When Ibn Masud came to Madina; he asked about it and was told that it was not as he had said; and that this condition referred to foster-mothers. Ibn Masud returnedto Kufa;and he had just reached his dwelling when the man who had asked him for the opinion came to visit and he ordered him to separate from his wife. Malik said that if a man married the mother of a woman who was his wife and he had sexual relations with the mother then his wife was haram for him; and he had to separate from both of them. They were both haram to him forever; if he had had sexual relations with the mother. If he had not had relations with the mcther; his wife was not haram for him; and he separated from the mother. Malik explained further about the man who married a woman; and then married her mother and cohabited with her; The mother will never be halal for him; and she is not halal for his father or his son; and any daughters of hers are not halal for him and so his wife is haram for him. Malik said; Fornication however; does not make any of that haram because Allah; the Blessed; the Exalted; mentioned the mothers of your wives; as one whom marriage made haram; and he didnt mention the making haram by fornication. Every marriage in a halal manner in which a man cohabits with his wife; is a halal marriage. MuwataMalik-017-001-35333Yahya related to me from Malik from Ibn Shihab from Said Ibn AlMusayab and from Sulayman Ibn Yasar that Tulayha AlAsadiya was the wife of Rushayd AlThaqafi. He divorced her; and she got married in her idda-period. Umar Ibn AlKhattab beat her and her husband with a stick several times; and separated them. Then Umar Ibn AlKhattab said; If a woman marries in her idda-period; and the new husband has not consummated the marriage; then separate them; and when she has completed the idda of her first husband; the other becomes a suitor. If he has consummated the marriage then separate them. Then she must complete her idda from her first husband; and then the idda from the other one; and they are never to be reunited. Malik added; Said Ibn AlMusayab said that she had her dowry because he had consummated the marriage. MuwataMalik-017-001-35348Yahya related to me from Malik from Ibn Shihab; and he had heard from AlQasim Ibn Muhammad that they said; When a free man marries a slave-girl and consummates the marriage; she makes him muhsan. Malik said; All of the people of knowledge I have seen said that a slave-girl makes a free man muhsan when he marries her and consummates the marriage. Malik said; A slave makes a free woman muhsana when he consummates a marriage with her and a free woman only makes a slave muhsan when he is freed and he is her husband and has had sexual relations with her after he has been set free. If he parts from her before he is free; he is not a muhsan unless he marries her after having been set free and he consummates the marriage. Malik said; When a slave-girl is married to a free man and then he separates from her before she is set free; his marriage to her does not make her muhsana. She is not muhsana until she has married after she has been set free and she has had intercourse with her husband. That gives her ihsan. If she is the wife of a freeman and then she is set free while she is his wife before he separates from her; the man makes her muhsana if he has intercourse with her after she has been set free. MuwataMalik-017-001-35351Yahya related to me from Malik that he heard Rabia Ibn Abdulrahman say that a slave could marry four women. Malik said; This is the best of what I have heard about the matter. Malik said; The slave differs with the muhallil if the slave is given permission by his master for his ex-wife. If his master does not give him permission; he separates them. The muhallil is separated in any case if he intends to make the woman halal by marriage. Malik said; When a slave is owned by his wife or a husband owns his wife; the possession of each of them is rendered void without divorce. If a man; for instance; is married to a slave-girl; and then he buys her; he must divorce her as a matter of course. They can then re- marry. If they re-marry afterwards; that separation was not divorce. The Book of Zakat. On twenty-four camels or less zakat is paid with sheep; one ewe for every five camels. On anything above that; up to thirty-five camels; a camel in its second year; and; if there is no she camel in its second year; a male camel in its third year. On anything above that; up to forty-five camels; a camel in its third year. On anything above that; up to sixty camels; a she camel in its fourth year that is ready to be sired. On anything above that; up to seventy-five camels; a camel in its fifth year. On anything above that; up to ninety camels; two camels in their third year. On anything above that; up to one hundred and twenty camels; two camels in their fourth year that are ready to be sired. On any number of camels above that; for every forty camels; a camel in its third year; and for every fifty; a camel in its fourth year. On grazing sheep and goats; if they come to forty or more; up to one hundred and twenty head; one ewe. On anything above that; up to two hundred head; two ewes. On anything above that; up to three hundred; three ewes. On anything above that; for every hundred; one ewe. A ram should not be taken for zakat. nor an old or an injured ewe; except as the zakat-collector thinks fit. MuwataMalik-017-001-35572Yahya said that Malik said; concerning two associates; If they share one herdsman; one male animal; one pasture and one watering place then the two men are associates; as long as each one of them knows his own property from that of his companion If someone cannot tell his property apart from that of his fellow; he is not an associate; but rather; a co-owner Malik said; It is not obligatory for both associates to pay zakat unless both of them have a zakatable amount of livestock. If; for instance; one of the associates has forty or more sheep and goats and the other has less than forty sheep and goats; then the one who has forty has to pay zakat and the one who has less does not. If both of them have a zakatable amount of livestock then both of them are assessed together i.e the flock is assessed as one and both of them have to pay zakat. If one of them has a thousand sheep; or less; that he has to pay zakat on; and the other has forty; or more; then they are associates; and each one pays his contribution according to the number of animals he has - so much from the one with a thousand; and so much from the one with forty. Malik said; Two associates in camels are the same as two associates in sheep and goats; and; for the purposes of zakat; are assessed together if each one of them has a zakatable amount of camels. That is because the Messenger of Allah; may Allah bless him and grant him peace; said; There is no zakat on less than five head of camels; and Umar Ibn AlKhattab said; On grazing sheep and goats; if they come to forty or more - one ewe. Yahya said that Malik said; This is what I like most out of what I have heard about the matter. Malik said that when Umar Ibn AlKhattab said; Those separated should not be gathered together nor should those gathered together be separated in order to avoid paying zakat; what he meant was the owners of livestock. Malik said; What he meant when he said; Those separated should not be gathered together is; for instance; that there is a group of three men; each of whom has forty sheep and goats; and each of whom thus has to pay zakat. Then; when the zakat collector is on his way ;they gather their flocks together so that they only owe one ewe between them. This they are forbidden to do. What he meant when he said; nor should those gathered together be separated; is; for instance; that there are two associates; each one of whom has a hundred and one sheep and goats; and each of whom must therefore pay three ewes. Then; when the zakat collector is on his way; they split up their flocks so that they only have to pay one ewe each. This they are forbidden to do. And so it is said; Those separated should not be gathered together nor should those gathered together be separated in order to avoid paying zakat.
