They have forgotten Allah; so He hath forgotten them. Verily the Hypocrites are rebellious and perverse.

When ye do divorce women, divorce them at their prescribed periods, and count (accurately), their prescribed periods: And fear Allah your Lord: and turn them not out of their houses, nor shall they (themselves) leave, except in case they are guilty of some open lewdness, those are limits set by Allah: and any who transgresses the limits of Allah, does verily wrong his (own) soul: thou knowest not if perchance Allah will bring about thereafter some new situation.

On them is a round of Evil: the Wrath of Allah is on them: He has cursed them and got Hell ready for them: and evil is it for a destination.

Surat AlFath Ayah 25Surat AlFath-0.24111هُمُ الَّذِينَ كَفَرُوا وَصَدُّوكُمْ عَنِ الْمَسْجِدِ الْحَرَامِ وَالْهَدْيَ مَعْكُوفًا أَنْ يَبْلُغَ مَحِلَّهُ وَلَوْلَا رِجَالٌ مُؤْمِنُونَ وَنِسَاءٌ مُؤْمِنَاتٌ لَمْ تَعْلَمُوهُمْ أَنْ تَطَئُوهُمْ فَتُصِيبَكُمْ مِنْهُمْ مَعَرَّةٌ بِغَيْرِ عِلْمٍ لِيُدْخِلَ اللَّهُ فِي رَحْمَتِهِ مَنْ يَشَاءُ لَوْ تَزَيَّلُوا لَعَذَّبْنَا الَّذِينَ كَفَرُوا مِنْهُمْ عَذَابًا أَلِيمًاThey are the ones who denied Revelation and hindered you from the Sacred Mosque and the sacrificial animals, detained from reaching their place of sacrifice. Had there not been believing men and believing women whom ye did not know that ye were trampling down and on whose account a crime would have accrued to you without (your) knowledge, (Allah would have allowed you to force your way, but He held back your hands) that He may admit to His Mercy whom He will. If they had been apart, We should certainly have punished the Unbelievers among them with a grievous Punishment.

There is not a good deed which ye do, but Allah is well-acquainted therewith.

Surat AlTalaq Ayah 4Surat AlTalaq-0.1899وَاللَّائِي يَئِسْنَ مِنَ الْمَحِيضِ مِنْ نِسَائِكُمْ إِنِ ارْتَبْتُمْ فَعِدَّتُهُنَّ ثَلَاثَةُ أَشْهُرٍ وَاللَّائِي لَمْ يَحِضْنَ وَأُولَاتُ الْأَحْمَالِ أَجَلُهُنَّ أَنْ يَضَعْنَ حَمْلَهُنَّ وَمَنْ يَتَّقِ اللَّهَ يَجْعَلْ لَهُ مِنْ أَمْرِهِ يُسْرًاSuch of your women as have passed the age of monthly courses, for them the prescribed period, if ye have any doubts, is three months, and for those who have no courses (it is the same): for those who carry (life within their wombs), their period is until they deliver their burdens: and for those who fear Allah, He will make their path easy.
Surat AlNisa Ayah 75Surat AlNisa-0.1592وَمَا لَكُمْ لَا تُقَاتِلُونَ فِي سَبِيلِ اللَّهِ وَالْمُسْتَضْعَفِينَ مِنَ الرِّجَالِ وَالنِّسَاءِ وَالْوِلْدَانِ الَّذِينَ يَقُولُونَ رَبَّنَا أَخْرِجْنَا مِنْ هَذِهِ الْقَرْيَةِ الظَّالِمِ أَهْلُهَا وَاجْعَلْ لَنَا مِنْ لَدُنْكَ وَلِيًّا وَاجْعَلْ لَنَا مِنْ لَدُنْكَ نَصِيرًاAnd why should ye not fight in the cause of Allah and of those who, being weak, are ill-treated (and oppressed)?- Men, women, and children, whose cry is: "Our Lord! Rescue us from this town, whose people are oppressors; and raise for us from Thee one who will protect; and raise for us from Thee one who will help!"
Surat AlAhzab Ayah 55Surat AlAhzab-0.1190لَا جُنَاحَ عَلَيْهِنَّ فِي آبَائِهِنَّ وَلَا أَبْنَائِهِنَّ وَلَا إِخْوَانِهِنَّ وَلَا أَبْنَاءِ إِخْوَانِهِنَّ وَلَا أَبْنَاءِ أَخَوَاتِهِنَّ وَلَا نِسَائِهِنَّ وَلَا مَا مَلَكَتْ أَيْمَانُهُنَّ وَاتَّقِينَ اللَّهَ إِنَّ اللَّهَ كَانَ عَلَى كُلِّ شَيْءٍ شَهِيدًاThere is no blame (on these ladies if they appear) before their fathers or their sons, their brothers, or their brother's sons, or their sisters' sons, or their women, or the (slaves) whom their right hands possess. And, (ladies), fear Allah; for Allah is Witness to all things.

SahihAlBukhari-017-001-1957Narrated Aisha: Mother of the Believers: We; the wives of the Prophet ﷺ were all sitting with the Prophet ﷺ and none of us had left when Fatima came walking; and by Allah; her gait was very similar to that of Allah Messenger ﷺ. When he saw her; he welcomed her; saying; Welcome; O my daughter! Then he made her sit on his right or his left; confided something to her; whereupon she wept bitterly. When he noticed her sorrow; he confided something else to her for the second time; and she started laughing. Only I from among the Prophet wives said to her; O Fatima ; Allah Messenger ﷺ selected you from among us for the secret talk and still you weep? When Allah Messenger ﷺ got up and went away ; I asked her; What did he confide to you? She said; I wouldnt disclose the secrets of Allah Messenger ﷺ But when he died I asked her; I beseech you earnestly by what right I have on you; to tell me that secret talk which the Prophet had with you She said; As you ask me now; yes; I will tell you. She informed me; saying; When he talked to me secretly the first time; he said that Gabriel used to review the Quran with him once every year. He added; But this year he reviewed it with me twice; and therefore I think that my time of death has approached. So; be afraid of Allah; and be patient; for I am the best predecessor for you in the Hereafter. Fatima added; So I wept as you Aisha witnessed. And when the Prophet ﷺ saw me in this sorrowful state; he confided the second secret to me saying; O Fatima! SahihMuslim-017-001-17491Yazid Bin AlAsamm reported: A newly wedded person of Medina invited us to a wedding feast; and he served us thirteen lizards. There were those who ate it and those who abandoned it. I met Ibn Abbas the next day; and informed him about this in the presence of many persons. Some of them said that the Messenger of Allah ﷺ had observed: I neither eat it nor forbid anyone from eating it; nor declare it to be unlawful. Thereupon Ibn Abbas said: Sad it is what you say! Allah Apostle ﷺ has not been sent; but to declare in clear words the lawful and the unlawful things. We were once with Allah Messenger may peace be. upon him as he was with Maimuna; and there were with him AlFadl Bin Abbas; Khalid Bin Walid and some women also when a tray of food containing flesh was presented to him. As Allah Apostle ﷺ was about to eat that; Maimuna said: It is the flesh of the lizard. He withdrew his hand saying: That is the flesh which I never eat; but he said to them those who were present there : You may eat. AlFadl ate out of that; so did Khalid b Walid; and the women. SahihMuslim-017-001-17815It has been narrated on the authority of Aisha; the wife of the Prophet ﷺ. She said: When the believing women migrated to Medina and came to the Messenger of Allah ﷺ ; they would be tested in accordance with the following words of Allah. the Almighty and Exalted: O Prophet; when believing women come to thee to take the oath of fealty to thee that they will not associate in worship anything with God; that they will not steal. that; they will not commit adultery... to the end of the verse lx. 62. Whoso from the believing women accepted these conditions and agreed to abide by them were considered to have offered themselves for swearing fealty. When they had formally declared their resolve to do so; the Messenger of Allah may peace he upon him would say to them: You may go. I have confirmed your fealty. By God; the hand of the Messenger of Allah ﷺ never touched the hand of a woman. He would take the oath of fealty from them by oral declaration. By God; the Messenger of Allah ﷺ never took any vow from women except that which God had ordered him to take; and his palm never touched the palm of a woman. SahihMuslim-017-001-18128It has been narrated on the authority of Jabir that the Messenger of Allah ﷺ said: Who will kill Kaab Bin Ashraf? He has maligned Allah; the Exalted; and His Messenger. Muhammad Bin Maslama said: Messenger of Allah; do you wish that I should kill him? He said: Yes. He said: Permit me to talk to him in the way I deem fit. He said: Talk as you like. So; Muhammad Bin Maslama came to Kaab and talked to him; referred to the old friendship between them and said: This man i. e. the Holy Prophet has made up his mind to collect charity from us and this has put us to a great hardship. When be heard this; Kaab said: By God; you will be put to more trouble by him. Muhammad Bin Maslama said: No doubt; now we have become his followers and we do not like to forsake him until we see what turn his affairs will take. I want that you should give me a loan. He said: What will you mortgage? He said: What do you want? He said: Pledge me your women. He said: You are the most handsome of the Arabs; should we pledge our women to you? He said: Pledge me your children. He said: The son of one of us may abuse us saying that he was pledged for two wasqs of dates; but we can pledge you cur weapons. He said: All right. Then Muhammad Bin Maslama promised that he would come to him with Harith; Abu Abs Bin Jabr and Abbad Bin Bishr. So they came and called upon him at night. He came down to them. Sufyan says that all the narrators except Amr have stated that his wife said: I hear a voice which sounds like the voice of murder. He said: It is only Muhammad Bin Maslama and his foster-brother; Abu Naila. When a gentleman is called at night even it to be pierced with a spear; he should respond to the call. Muhammad said to his companions: As he comes down; I will extend my hands towards his head and when I hold him fast; you should do your job. So when he came down and he was holding his cloak under his arm; they said to him: We sense from you a very fine smell. He said: Yes; I have with me a mistress who is the most scented of the women of Arabia. He said: Allow me to smell the scent on your head. He said: Yes; you may smell. So he caught it and smelt. Then he said: Allow me to do so once again. He then held his head fast and said to his companions: Do your job. SahihMuslim-017-001-18148It has been narrated on the authority of Yazid Bin Hurmuz that Najda wrote to Ibn Abbas inquiring of him five things. Ibn Abbas said: If I had not the fear of committing sin for concealing the knowledge I would not have written to him. Najda wrote to him saying after praising the Almighty and invoking blessings on the Prophet : Tell me whether the Messenger of Allah ﷺ took women to participate with him in Jihad; if he did ; whether he allotted them a regular share from the booty; whether he killed the children of the enemy in the war ; how long an orphan would be entitled to consideration as such; and for whom the Khums fifth part of the booty was booty. Ibn Abbas wrote to him: You have written asking me whether the Messenger of Allah ﷺ took women with him to participate in Jihad. He did take them to the battle and sometimes he fought along with them. They would treat the wounded and were given a reward from the booty; but he did not assign any regular share for them. And the Messenger of Allah ﷺ did not kill the children of the enemy; so you should not kill the children. Also you have written to me asking me when the orphanhood of an orphan comes to an end. By my life; if a man has become bearded but is still incapable of getting his due from others or fulfilling his obligation towards them; he is yet an orphan to be treated as such ; but when he can look after his interests like grown-up people; he is no longer an orphan. And you have written to me inquiring about Khums as to whom it is meant for. This news reached a woman of the tribe of Asad who was called Umm Yaqub and she used to recite the Holy Quran. She came to him and said: What is this news that has reached me from you that you curse those women who tattooed and those women who have themselves tattooed; the women who pluck hair from their faces and who make spaces between their teeth for beautification changing what God has created? Thereupon Abdullah said: Should I not curse one upon whom Allah Messenger ﷺ has invoked curse and that is in the Book also. Thereupon that woman said: I read the Quran from cover to cover; but I did not find that in it. whereupon he said: If you had read thoroughly you would have definitely found this in that as Allah; the Exalted and Glorious; has said: What Allah Messenger brings for you accept that and what he has forbidden you; refrain from that. That woman said: I find this thing in your wife even now. Thereupon he said: Go and see her. She reported: I went to the wife of Abdullah but found nothing of this sort in her. When he talked to me secretly for the first time he informed me that Gabirel was in the habit of reciting the Quran along with him once or twice every year; but this year it had been twice and so he perceived his death quite near; so fear Allah and be patient and he told me that he would be a befitting forerunner for me and so I wept as you saw me. And when he saw me in grief he talked to me secretly for the second time and said: Fatima; are you not pleased that you should be at the head of the believing women or the head of this Umma? And when he died I again asked her and she said that he the Holy Prophet told her: Gabriel used to recite the Quran to me once a year and for this year it was twice and so I perceived that my death had drawn near; and that I Fatima would be the first amongst the members of his family who would meet him in the Hereafter. He shall be my good forerunner and it made me weep. He again talked to me secretly saying : Arent you pleased that you should be the sovereign amongst the believing women or the head of women of this Ummah? SahihMuslim-017-001-21520Ibn Abbas Allah be pleased with them reported. I had always been anxious to ask Umar Allah be pleased with him about the two ladies amongst the wives of Allah Prophet may peace be upon Lim about whom Allah; the Exalted; said: If you both turn in repentance to Allah; then indeed your hearts are inclined to this Ixvi. 4 ; until Umar Allah be pleased with him set out for Hajj and I also went along with him. And as we were going along a path; Umar Allah be pleased with hiyn went Aasi de and I also went Aasi de with him with a jug of water. He answered the call of nature; and then came to me and I poured water over his hands and he performed ablution I said: Commander of the Faithful; who are the two ladies amongst the wives of Allah Prophet ﷺ about whom Allah; the Exalted and Majestic; said: If you both turn to Allah in repentance; then indeed your heart are inclined to it? Umar Allah he pleased with him said: How strange is it for you; Ibn Abbas! Zuhri said: By Allah; he disliked what he asked about; but did not keep it a secret. He Umar said: They are Hafsa and Aisha; and he then began to narrate the hadith and said: We were such people among the Quraish who dominated women; and as we reached Medina we found there people who were dominated by their women; and our women began to learn the habits of their women. He further said: And my house was situated in the suburb of Aledina in the tribe of Banu Umaya Bin Zaid. One day I became angry with my wife and she retorted upon me. I did not like that she should retort upon me. She said: You disapprove of my retorting upon you By Allah; the wives of Allah Apostle ﷺ retort upon him; and one of them detaches herself from him for the day until the night. So I Umar went out and visited Hafsa and said: Do you retort upon Allah Messenger ﷺ ? She said: Yes. I said; Does any one of you detach herself from him from the day to the night? She said: Yes. He said: She who did like it amongst you in fact failed and incurred loss. Does everyone amongst you not fear the wrath of Allah upon her due to the wrath of His Messenger ﷺ ; and as a result thereof she may perish? So do not retort upon Allah Messenger ﷺ and do not ask him for anything; but ask me that which you desire; and the frank behaviour of your companion may not mislead you; if she is more graceful and is dearer to Allah Messenger ﷺ than you meaning Aisha Allah be pleased with her. He Hadrat Umar further said: I had a compalaion from the Ansar and; we used to remain in the company of the Messenger ﷺ turn by turn. He remained there for a day while I remained there on the other day; and he brought me the news about the revelation and other matter ; and I brought him the news like this. And we discussed that the Ghassanids were shoeing the horses in order to attack us. Id y companion once attended the Apostle. and then came to me at night and knocked at my door and called me; and I came out to him; and he said: A matter of great importance has happened. I said: What is that? Have the Ghassanids come? He said: No; but even more serious and more significant than that: the Prophet ﷺ has divorced his wives. I said: Hafsa has failed and has incurred loss. and I feared that it would happen. When it was dawn I observed the dawn prayer and dressed myself; and then came there in the house of the Holy Prophet and visited Hafsa; and she was weeping. I said: Has Allah Messenger ﷺ divorced you all ? She said: I do not know. He has; however; separated himself in his attic. I came to a black servant and said to him: Seek permission for Umar. He went in and then came to me and said: I made mention of you to him; but he kept quiet. I then went to the pulpit and sat there; and there was a group of people sitting by it and some of then were weeping. I sat there for some time; until I was overpowered by that very idea which was in my mind. I then came back to the boy and said to him: Seek permission for Umar. He went in and came to me and said: I made mention of you to him but he kept quiet. I was about to turn back when the boy called me and said: Go in; permission has been granted to you. I went in and greeted Allah Messenger ﷺ and he was reclining against the couch of mat and it had left its marks upon his side. I said: Messenger of Allah; have you divorced your wives? He raised his head towards me and said: No. I said: Allah is the Greatest. Messenger of Allah; I wish if you had seen how we the people of Quraish had domination over women but when we came to Medina we found people whom their women dominated. So our women began to learn from their women. One dily I became angry with my wife and she began to retort upon me. I did not approve that she should retort upon me. She said: You do not like that I should retort upon you; but; by Allah. the wives of Allah Apostle ﷺ retort upon him and any one of them separates herself from him for a day until night. I said: He who did that amongst them in fact failed and incurred loss. Does any of them feel sate from the wrath of Allahupon her due to the wrath of Allah Messenger ﷺ ; and she has certainly perished. Allah Messtnger ﷺ smiled; I said: Messenger of Allah; I visited Hafsa and said: The behaviour of your companion Aisha may not mislead you; If she is more graceful than you and is dearer to Allah Messenger ﷺ than you. Allah Messenger ﷺ smiled for the second time. I said: Allah Messenger; way I talk to you about agreeable things? He said: Yes. I sat down and lifted my head to see things in the house and; by Allah; I did not see anything significant besides three hides. I said: Messenger of Allah; supplicate the Lord that He should make life prosperous for your Ummah as He has made plentiful for the people of Persia and Rome in spite of the fact that they do no; worship Allah; the Exalted and Majestic; whereupon he Allah Messenger sat up an I then said: Ibn AlKhattab; do you doubt that they are a nation whom their nice things have been given immediately in the life of this world. I said: Allah Messenger! seek pardon for me. And he Allah Messenger had taken an oath that he would not visit them for a month due to extreme annoyance with them until Allah showed His displeasure to him Allah Messenger. Zuhri said: Urwa informed me that AIsha Allah be pleased with her said: When twenty-nine nights were over; Allah Messenger ﷺ visited me; and he began his visit with me. I said: Messenger of Allah; you had taken an oath that you would not visit us for a month; while you have visited after I have counted only twenty-nine nights. Thereupon he said: The month may also be of twenty-nine days. He then said: Aisha; I am going to talk to you about a matter; and you should not be hasty in it and do not give your final decision until you have consulted your parents. He then recited this verse to me: O Prophet; say to your wives till he reached mighty reward xxxiii. 28. Aisha Allah be pleased with her said: By Allah; he knew that my parents would not allow me to separate from him. I said: Is there any need to consult my parents in this matter? I in fact choose Allah and His Messenger ﷺ and the abode in the Hereafter. Mamar said: Ayoub reported to me that Aisha said: Dont inform your wives that I have chosen you; whereupon Allah Apostle ﷺ said: Verily Allah has sent me as a conveyer of message; and He has not sent me as a source of hardship to others. So when they prayed Zuhr; they stood up and said that. The Messenger of Allah said: As for that which was allocated to myself and to Banu Abd AlMuttalib; it is yours. The Muhajirun said: That which was allocated to us is for the Messenger of Allah. The Ansar said: That which was allocated to us is for the Messenger of Allah. AlAqra Bin Habis said: As for myself and Banu Tamim; then no we will not give it up. Uyaynah Bin Housn said: As for myself and Banu Fazarah; then no we will not give it up. AlAbbas Bin Mirdas said: As for myself and Banu Sulaim; then no we will not give it up. Banu Sulaim stood up and said: You lied; whatever was allocated to us; it is for the Messenger of Allah. The Messenger of Allah said: O people; give their women and children back to them. Whoever gives back anything of these spoils of war; he will have six camels from the spoils of war that Allah grants us next. Then he mounted his riding-animal and the people surrounded him; saying: Distribute our spoils of war among us. They made him go back toward a tree on which his Rida upper-wrap got caught. He said: O people! Give me back my Rida. By Allah! If there were cattle as many in number as the trees of Tihamah I would distribute them among you; then you would not find me a miser; a coward or a liar. Then he went to a camel and took a hair from its hump between two of his fingers and said: Look! I do not have any of the spoils of war. All I have is the Khums; and the Khums will be given back to you. A man stood up holding a ball of yarn made from goat hair and said: O Messenger of Allah; I took this to fix my camel-saddle. He said: What was allocated to myself and to Banu Abd AlMuttalib is for you. He said: Is this so important? I dont need it! And he threw it down. He said: O people! But if you know not their fathers names; call them your brothers in Faith and Mawalikum your freed slaves. So her guardian wants to marry her without being fair with regard to her dowry; and without giving her what someone else would give her. So they were forbidden to marry them unless they were fair to them and gave them the highest possible dowry that is customarily given; and they were commanded to marry other women of their choice. Urwah said: Aisha said: Then later on; Allah; the Mighty and Sublime; revealed concerning them: They ask your legal instruction concerning women; say: Allah instructs you about them; and about what is recited unto you in the Book concerning the orphan girls whom you give not the prescribed portions and yet whom you desire to marry. Aisha said: What Allah; Most High; mentioned here that is recited in the Book is the first Verse in which it says: And if you fear that you shall not be able to deal justly with orphan girls then marry other women of your choice. Aisha said: What is referred to in the other Verse -and yet whom you desire to marry- is the desire of one of you not to marry orphan girl who is under his care if she is lacking in wealth and beauty. She said O my nephew; this means the female orphan who is under the protection of her guardian and she holds a share in his property and her property and beauty attracts him; so her guardian intends to marry her without doing justice to her in respect of her dower and he gives her the same amount of dower as others give her. They i.e.; the guardians were prohibited to marry them except that they do justice to them and pay them their maximum customary dower and they were asked to marry women other than them i.e.; the orphans who seem good to them. Urwah reported that Aisha said The people then consulted the Apostle of Allaah ﷺ about women after revelation of this verse. Thereupon Allaah the Exalted sent down the verse They consult thee concerning women. Say Allaah giveth you decree concerning them and the scripture which hath been recited unto you giveth decree concerning female orphans unto whom you give not that which is ordained for them though you desire to marry them. She said The mention made by Allaah about the Scripture recited to them refers to the former verse in which Allaah has said And if ye fear that ye will not deal fairly by the orphans; marry of the women; who seem good to you. Aisha said The pronouncement of Allaah ; the Exalted in the latter verse though you desire to marry them means the disinterest of one of you in marrying a female orphan who was under his protection; but she said little property and beauty. So they were prohibited to marry them for their interest in the property and beauty of the female orphans due to their disinterest in themselves except that they do justice to them. The fact is that this clan of the Ansar; who were idolaters; lived in the company of the Jews who were the people of the Book. They the Ansar accepted their superiority over themselves in respect of knowledge; and they followed most of their actions. The people of the Book i.e. the Jews used to have intercourse with their women on one side alone i.e. lying on their backs. This was the most concealing position for the vagina of the women. This clan of the Ansar adopted this practice from them. But this tribe of the Quraysh used to uncover their women completely; and seek pleasure with them from in front and behind and laying them on their backs. When the muhajirun the immigrants came to Medina; a man married a woman of the Ansar. He began to do the same kind of action with her; but she disliked it; and said to him: We were approached on one side i.e. lying on the back ; do it so; otherwise keep away from me. This matter of theirs spread widely; and it reached the Messenger of Allah ﷺ. So Allah; the Exalted; sent down the Quranic verse: Your wives are a tilth to you; so come to your tilth however you will; i.e. from in front; from behind or lying on the back. SunanAbuDawoud-017-001-25013Narrated Abu Huraira: Abu Nadrah reported: An old man of Tufawah said to me: I was a guest of Abu Huraira at Medina. I did not find any one of the companions of the Prophet ﷺ more devoted to worship and more hospitable than Abu Huraira. One day I was with him when he was sitting on his bed. He had a purse which contained pebbles or kernels. A black slave-girl of his was sitting below. Counting them he was glorifying Allah. When the pebbles or the kernels in the purse were finished; she gathered them and put them again in the purse; and gave it to him. He said: Should I not tell you about me and about the Messenger of Allah ﷺ ? I said: Yes. He said: Once when I was laid up with fever in the Masjid; the Messenger of Allah ﷺ came and entered the Masjid; and said: Who saw the youth of AlDaws. He said this three times. A man said: Messenger of Allah; there he is; laid up with fever on one side of the Masjid. He moved; walking forward till he reached me. He placed his hand on me. He had a kind talk with me; and I rose. He then began to walk till he reached the place where he used to offer his prayer. He paid his attention to the people. There were two rows of men and one row of women; or two rows of women and one row of men the narrator is doubtful. He then said: If Satan makes me forget anything during the prayer; the men should glorify Allah; and the women should clap their hands. The Messenger of Allah ﷺ then prayed and he did not forget anything during the prayer. He said: Be seated in your places; be seated in your places. The narrator; Mousa; added the word here. He then praised Allah and exalted Him; and said: Now to our topic. The agreed version begins: He then said: Is there any man among you who approaches his wife; closes the door; covers himself with a curtain; and he is concealed with the curtain of Allah? They replied: Yes. He said: later he sits and says: I did so-and-so; I did so-and-so. The people kept silence. He then turned to the women and said to them : Is there any woman among you who narrates it? They kept silence. Then a girl fell on one of her knees. The narrator; Muammil; said in his version: a buxom girl. She raised her head before the Messenger of Allah ﷺ so that he could see her and listen to her. She said: Messenger of Allah; they the men describe the secrets of intercourse and they the women also describe the secrets of intercourse to the people. He said: Do you know what the similitude is? He said: The likeness of this act is the likeness of a female Satan who meets the male Satan on the roadside; he fulfils his desire with her while the people are looking at him. Beware! The perfume of men is that whose smell becomes visible and its colour does not appear. Beware! The perfume of women is that whose colour becomes visible and whose smell is not obvious. Abu Dawud said: From here I remembered this tradition from Muammil and Mousa: Beware! No man should lie with another man; no woman should lie with another woman except with one child or father. He also mentioned a third which I have forgotten. This has been mentioned in the version of Mousaddad; but I do not remember it as precisely as I like. That was the first blood-money decided by the Messenger of Allah ﷺ for payment. Uyaynah spoke about the killing of AlAshjai; for he belonged to Ghatafan; and AlAqra Ibn Habis spoke on behalf of Muhallam; for he belonged to Khunduf. The voices rose high; and the dispute and noise grew. So the Messenger of Allah ﷺ said: Do you not accept blood-money; Uyaynah? Uyaynah then said: No; I swear by Allah; until I cause his women to suffer the same fighting and grief as he caused my women to suffer. Again the voices rose high; and the dispute and noise grew. The Messenger of Allah ﷺ said: Do you not accept the blood-money Uyaynah? Uyaynah gave the same reply as before; and a man of Banu Layth called Mukaytil stood up. He had a weapon and a skin shield in his hand. He said: I do not find in the beginning of Islam any illustration for what he has done except the one that some sheep came on; and those in the front were shot; hence those in the rear ran away. The other example is that make a law today and change it. The Messenger of Allah ﷺ said: Fifty camels here immediately and fifty when we return to Medina. This happened during some of his journeys. Muhallam was a tall man of dark complexion. He was with the people. They continued to make effort for him until he was released. He sat before the Messenger of Allah ﷺ ; with his eyes flowing. He said: Messenger of Allah! I have done the act of which you have been informed. I repent to Allah; the Exalted; so ask Allah forgiveness for me. Messenger of Allah! Abu Salamah added: He Muhallam then got up while he was wiping his tears with the end of his garment. The agreed version then goes: The women who spaces between their teeth for beauty; changing what Allah has created. When a woman of Banu Asad called Umm Yaqub; who read the Quran according to the version of Uthman heard it; she came to him according to the agreed version and said: I have heard that you have cursed the women who tattoo; those have themselves tattooed; those who add false hair according to the version of Muhammad ; those pluck hairs from their faces; and those who make spaces between their teeth according to the agreed version ; for changing what Allah has created according to the version of Uthman. He said: Why should I not curse those whom the Messenger of Allah ﷺ had cursed and those who were mentioned in Allah Book ? She said: I have read it from cover to cover and have not found in it. He said: I swear by Allah; if you read it; you would have found it. He then read: What the Apostle has brought you accept; and what he has forbidden refrain from it. She said: I find some of these thing in you wife. He said: Enter the house and see. She said: I then entered the house and came out. He asked: What did you see ? She said: I did not see anything. He said: Had it been so; she would have not have been with us. MuwataMalik-017-001-34743Yahya said that Malik said; The way of doing things in our community about which there is no dispute is that women do not swear in the swearing for the intentional act. If the murdered man only has female relatives; the women have no right to swear for blood and no pardon in murder. Yahya said that Malik said about a man who is murdered; If the paternal relatives of the murdered man or his mawali say; We swear and we demand our companion blood; that is their right. Malik said; If the women want to pardon him; they cannot do that. The paternal relatives and mawali are entitled to do that more than them because they are the ones who demand blood and swear for it. Malik said; If the paternal relatives or mawali pardon after they demand blood and the women refuse and say; We will not abandon our right against the murderer of our companion; the women are more entitled to that because whoever takes retaliation is more entitled than the one who leaves it among the women and paternal relatives when the murder is established and killing obliged. Malik said; At least two claimants must swear in murder. The oaths are repeated by them until they swear fifty oaths; then they have the right to blood. That is how things are done in our community. Malik said; When people beat a man and he dies in their hands; they are all slain for him. If he dies after their beating; there is swearing. If there is swearing; it is only against one man and only he is slain. We have never known the swearing to be against more than one man. Malik spoke about a slave who had his hand or foot broken and then the break mended. He said; The one who injured him is not obliged to pay anything. If that break causes him loss or scar; the one who injured him must pay according to what he diminished of the value of the slave. Malik said; What is done in our community about retaliation between slaves is that it is like retaliation between freemen. The life of the slave-girl for the life of the slave; and her injury for his injury. When a slave intentionally kills a slave; the master of the murdered slave has a choice. If he wishes; he kills him; and if he wishes; he takes the blood-money. If he takes the blood-money; he takes the value of his slave. If the owner of the slave who killed wishes to give the value of the murdered slave; he does it. If he wishes; he surrenders his slave. If he surrenders him; he is not obliged to do anything other than that. When the owner of the murdered slave takes the slave who murdered and is satisifed with him; he must not kill him. All retaliations between slaves for cutting off of the hand and foot and such things are dealt with in the same way as in the murder. Malik said about a muslim slave who injures a jew or christian; If the master of the slave wishes to pay blood-money for him according to the injury; he does it. Or else he surrenders him and he is sold; and the jew or christian is given the blood-money of the injury or all the price of the slave if the blood-money is greater than his price. MuwataMalik-017-001-34745Yahya said that Malik said; When the relatives of the deceased accept the blood-money then it is inherited according to the Book of Allah. Daughters of the dead man inherit and so do sisters; and whichever women would inherit from him ordinarily. If the women do not take all his inheritance; then what remains goes to the agnatic relations who most deserve to inherit from him in conjunction with the women. Malik said; When one of the heirs of a man killed by mistake attempts to take his due from the blood-money while his companions are absent; he may not do that; and he has no right to any of the blood-money; however large or small; unless the qasama has been completed by him. If he swears fifty oaths then he has the right to his portion of the blood-money. That is because the blood-money is not established as due without there being fifty oaths; and the blood- money is not established as due unless the responsibility for the blood is established. If any one of the heirs comes after that he swears a number of the oaths commensurate with his fraction of the inheritance and takes his right until all the heirs exact their complete right. If a maternal uncle comes he has one sixth and must swear one sixth of the fifty oaths. So whoever swears may take his due from the blood-money and whoever abstains annuls his right. If one of the heirs is absent or is a child who has not reached puberty; those who are present swear fifty oaths and if the one who was absent comes after that or the child reaches puberty; they swear. and they swear according to their due of the blood-money and according to their shares of inheritance from it. MuwataMalik-017-001-34907Malik related to me that he heard that Abu Salama Ibn Abdulrahman and Sulayman Ibn Yasar were both asked; Does one pronounce judgement on the basis of an oath with one witness? They both said; Yes. Malik said; The precedent of the sunna in judging by an oath with one witness is that if the plaintiff takes an oath with his witness; he is confirmed in his right. If he draws back and refuses to take an oath; the defendant is made to take an oath. If he takes an oath; the claim against him is dropped. If he refuses to take an oath; the claim is confirmed against him. Malik said; This procedure pertains to property cases in particular. It does not occur in any of the hadd-punishments; nor in marriage; divorce; freeing slaves; theft or slander. If some one says; Freeing slaves comes under property; he has erred. It is not as he said. Had it been as he said; a slave could take an oath with one witness; if he could find one; that his master had freed him. However; when a slave lays claim to a piece of property; he can take an oath with one witness and demand his right as the freeman demands his right. Malik said; The sunna with us is that when a slave brings somebody who witnesses that he has been set free; his master is made to take an oath that he has not freed him; and the slave claim is dropped. Malik said; The sunna about divorce is also like that with us. When a woman brings somebody who witnesses that her husband has divorced her; the husband is made to take an oath that he has not divorced her. If he takes the oath; the divorce does not proceed. Malik said; There is only one sunna of bringing a witness in cases of divorce and freeing a slave. The right to make an oath only belongs to the husband of the woman; and the master of the slave. Freeing is a hadd matter; and the testimony of women is not permitted in it because when a slave is freed; his inviolability is affirmed and the hadd punishments are applied for and against him. If he commits fornication and he is a muhsan; he is stoned. If he kills a slave; he is killed for it. Inheritance is established for him; between him and whoever inherits from him. If somebody disputes this; arguing that if a man frees his slave and then a man comes to demand from the master of the slave payment of a debt; and a man and two women testify to his right; that establishes the right against the master of the slave so that his freeing him is cancelled if he only has the slave as property; inferring by this case that the testimony of women is permitted in cases of setting free. The case is not as he suggests i.e. it is a case of property not freeing. It is like a man who frees his slave; and then the claimant of a debt comes to the master and takes an oath with one witness; demanding his right. By that; the freeing of the slave would be cancelled. Or else a man comes who has frequent dealings and transactions with the master of the slave. He claims that he is owed money by the master of the slave. Someone says to the master of the slave; Take an oath that you dont owe what he claims. If he draws back and refuses to take an oath; the one making the claim takes an oath and his right against the master of the slave is confirmed. That would cancel the freeing of the slave if it is confirmed that property is owed by the master. Malik said; It is the same case with a man who marries a slave-girl and then the master of the slave-girl comes to the man who has married her and claims; You and so-and-so have bought my slave-girl from me for such an amount of dinars. The husband of the slave-girl denies that. The master of the slave-girl brings a man and two women and they testify to what he has said. The sale is confirmed and his claim is considered true. So the slave-girl is haram for her husband and they have to separate; even though the testimony of women is not accepted in divorce. Malik said; It is also the same case with a man who accuses a free man; so the hadd falls on him. A man and two women come and testify that the one accused is a slave. That would remove the hadd from the accused after it had befallen him; even though the testimony of women is not accepted in accusations involving hadd punishments. Malik said; Another similar case in which judgement appears to go against the precedent of the sunna is that two women testify that a child is born alive and so it is necessary for him to inherit if a situation arises where he is entitled to inherit; and the child property goes to those who inherit from him; if he dies; and it is not necessary that the two women witnesses should be accompanied by a man or an oath even though it may involve vast properties of gold; silver; live-stock; gardens and slaves and other properties. However; had two women testified to one dirham or more or less than that in a property case; their testimony would not affect anything and would not be permitted unless there was a witness or an oath with them. Malik said; There are people who say that an oath is not acceptable with only one witness and they argue by the word of Allah the Blessed; the Exalted; and His word is the Truth; And call in to witness two witnesses; men; or if the two be not men; then one man and two women; such witnesses as you approve of. Surat 2 ayat 282. Such people argue that if he does not bring one man and two women; he has no claim and he is not allowed to take an oath with one witness. Malik said; Part of the proof against those who argue this; is to reply to them; Do you think that if a man claimed property from a man; the one claimed from would not swear that the claim was false? If he swears; the claim against him is dropped. If he refuses to take an oath; the claimant is made to take an oath that his claim is true; and his right against his companion is established. There is no dispute about this with any of the people nor in any country. By what does he take this? In what place in the Book of Allah does he find it? So if he confirms this; let him confirm the oath with one witness; even if it is not in the Book of Allah; the Mighty; the Majestic! It is enough that this is the precedent of the sunna. However; man wants to recognise the proper course of action and the location of the proof. Then she married when she was free to marry. She stayed with her husband for four and a half months; then gave birth to a fully developed child. Her husband went to Umar Ibn AlKhattab and mentioned that to him; so Umar called some of the old women of the Aljahiliya and asked them about that. One of the women said; I will tell you what happened with this woman. When her husband died; she was pregnant by him; but then the blood flowed from her because of his death and the child became dry in her womb. When her new husband had intercourse with her and the water reached the child; the child moved in the womb and grew. Umar Ibn AlKhattab believed her and separated them until she had completed her idda. He called to him but he did not reply. The Messenger of Allah; may Allah bless him and grant him peace; said; We belong to Allah; and to Him we are returning; and added; You are being taken from us; Ab AlRabi. The women cried out and wept; and Jabir began to silence them. The Messenger of Allah; may Allah bless him and grant him peace; said; Leave them; and when the necessary time comes; none of the women should cry. They said; Messenger of Allah; what is the necessary time? and he replied; When he dies. The dying man daughter said; By Allah; I hope that you will be a martyr; for you have completed your preparations for battle; and the Messenger of Allah; may Allah bless him and grant him peace; said; Allah has made his reward fall according to his intention. What do you consider dying a martyr to be? They said; Death in the way of Allah. If; however; he has had sexual relations with women; then he should not only return and do the tawaf Alifada; but he should also do an umra and sacrifice an animal. Allah; the Blessed and Exalted; says; And we appointed a method of sacrifice for every nation; which they followed; so let them not dispute with you about the matter; and call to your Lord. The Messenger of Allah; may Allah bless him and grant him peace; gave her permission to leave. Malik said; A woman menstruating at Mina stays until she has done tawaf of the House. There is no escape from that for her. If she has already done the tawaf Alifada and she starts to menstruate afterwards; she may leave for her country; since permission for the menstruating women to leave has been transmitted to us from the Messenger of Allah; may Allah bless him and grant him peace.
