SahihAlBukhari-017-001-227Narrated Abdullah Bin Ubaidullah Bin Abi Mulaika: One of the daughters of Uthman died at Mecca. We went to attend her funeral procession. Ibn Umar and Ibn Abbas were also present. I sat in between them or said; I sat beside one of them. Then a man came and sat beside me. Abdullah Bin Umar said to Amr Bin Uthman; Will you not prohibit crying as Allah Messenger ﷺ has said; The dead person is tortured by the crying of his relatives.? Ibn Abbas said; Umar used to say so. Then he added narrating; I accompanied Umar on a journey from Mecca till we reached AlBaida. There he saw some travelers in the shade of a Samura A kind of forest tree. He said to me ; Go and see who those travelers are. So I went and saw that one of them was Suhaib. I told this to Umar who then asked me to call him. So I went back to Suhaib and said to him; Depart and follow the chief of the faithful believers. Later; when Umar was stabbed; Suhaib came in weeping and saying; O my brother; O my friend! on this Umar said to him; O Suhaib! Are you weeping for me while the Prophet ﷺ said; The dead person is punished by some of the weeping of his relatives? Ibn Abbas added; When Umar died I told all this to Aisha and she said; May Allah be merciful to Umar. By Allah; Allah Messenger ﷺ did not say that a believer is punished by the weeping of his relatives. But he said; Allah increases the punishment of a non-believer because of the weeping of his relatives. Aisha further added; The Quran is sufficient for you to clear up this point as Allah has stated: No burdened soul will bear another burden. 35.18. Ibn Abbas then said; Only Allah makes one laugh or cry. SahihAlBukhari-017-001-243Narrated Abdullah Bin Umar: Saad Bin Ubada became sick and the Prophet ﷺ along with Abdulrahman Bin Auf; Saad Bin Abi Waqqas and Abdullah Bin Masud visited him to inquire about his health. When he came to him; he found him surrounded by his household and he asked; Has he died? They said; No; O Allah Apostle. The Prophet ﷺ wept and when the people saw the weeping of Allah Messenger ﷺ ﷺ they all wept. He said; Will you listen? Allah does not punish for shedding tears; nor for the grief of the heart but he punishes or bestows His Mercy because of this. The Prophet ﷺ said; They are being punished; but they are not being punished because of a major sin; yet their sins are great. One of them used not to save himself from being soiled with the urine; and the other used to go about with calumnies Namima. SahihAlBukhari-017-001-3735Narrated Ubaidullah Bin Adi Bin AlKhiyar: That AlMiswar Bin Makhrama and Abdulrahman Bin AlAswad Bin Abu Yaghuth had said to him; What prevents you from speaking to your uncle Uthman regarding his brother AlWalid Bin Uqba? The people were speaking against the latter for what he had done. Ubaidullah said; So I kept waiting for Uthman; and when he went out for the prayer; I said to him; I have got something to say to you as a piece of advice. Uthman said; O man! I seek Refuge with Allah from you. So I went away. When I finished my prayer; I sat with AlMiswar and Ibn Abu Yaghutb and talked to both of them of what I had said to Uthman and what he had said to me. They said; You have done your duty. So while I was sitting with them. Uthman Messenger came to me. They said; Allah has put you to trial. I set out and when I reached Uthman; he said; What is your advice which you mentioned a while ago? I recited Tashahhud and added; Allah has sent Muhammad and has revealed the Holy Book i.e. Quran to him. You O Uthman! were amongst those who responded to the call of Allah and His Apostle and had faith in him. And you took part in the first two migrations to Ethiopia and to Medina ; and you enjoyed the company of Allah Messenger ﷺ and learned his traditions and advice. Now the people are talking much about AlWalid Bin Uqba and so it is your duty to impose on him the legal punishment. Uthman then said to me; O my nephew! Did you ever meet Allah Messenger ﷺ ? I said; No; but his knowledge has reached me as it has reached the virgin in her seclusion. Uthman then recited Tashahhud and said; No doubt; Allah has sent Muhammad with the Truth and has revealed to him His Holy Book i.e. Quran and I was amongst those who responded to the call of Allah and His Apostle and I had faith in Muhammad Mission; and I had performed the first two migrations as you have said; and I enjoyed the company of Allah Messenger ﷺ and gave the pledge of allegiance to him. By Allah; I never disobeyed him and never cheated him till Allah caused him to die. Then Allah made Abu Bakr Caliph; and by Allah; I was never disobedient to him; nor did I cheat him. Then Umar became Caliph; and by Allah; I was never disobedient to him; nor did I cheat him. Then I became Caliph. Have I not then the same rights over you as they had over me? I replied in the affirmative. Uthman further said; The what are these talks which are reaching me from you? As for what you ha mentioned about AlWalid Bin Uqb; Allah willing; I shall give him the leg; punishment justly. Then Uthman ordered that AlWalid be flogged fort lashes. SahihAlBukhari-017-001-3755Narrated Ubada Bin AlSamit: Who had taken part in the battle of Badr with Allah Messenger ﷺ and had been amongst his companions on the night of AlAqaba Pledge: Allah Messenger ﷺ ; surrounded by a group of his companions said; Come along and give me the pledge of allegiance that you will not worship anything besides Allah; will not steal; will not commit illegal sexual intercourse will not kill your children; will not utter; slander; invented by yourself; and will not disobey me if I order you to do something good. Whoever among you will respect and fulfill this pledge; will be rewarded by Allah. And if one of you commits any of these sins and is punished in this world then that will be his expiation for it; and if one of you commits any of these sins and Allah screens his sin; then his matter; will rest with Allah: If He will; He will punish him and if He will;. He will excuse him. SahihAlBukhari-017-001-4440Narrated Ibn Abbas: Hilal Bin Umaiya accused his wife before the Prophet ﷺ of committing illegal sexual intercourse with Sharik Bin Sahma. The Prophet ﷺ said; Produce a proof; or else you would get the legal punishment by being lashed on your back. Hilal said; O Allah Messenger ﷺ ! If anyone of us saw another man over his wife; would he go to search for a proof. SahihAlBukhari-017-001-6074Narrated Ubada Bin AlSamit: who took part in the battle of Badr and was a Naqib a person heading a group of six persons ; on the night of AlAqaba pledge: Allah Apostle said while a group of his companions were around him; Swear allegiance to me for: 1. Not to join anything in worship along with Allah. 2. Not to steal. 3. Not to commit illegal sexual intercourse. 4. Not to kill your children. 5. SahihAlBukhari-017-001-6641Narrated Urwa Bin AlZubair: A lady committed theft during the lifetime of Allah Messenger ﷺ in the Ghazwa of AlFath; i.e. Conquest of Mecca. Her folk went to Usama Bin Zaid to intercede for her with the Prophet. When Usama interceded for her with Allah Messenger ﷺ ; the color of the face of Allah Messenger ﷺ changed and he said; Do you intercede with me in a matter involving one of the legal punishments prescribed by Allah? Usama said; O Allah Messenger ﷺ ! Ask Allah Forgiveness for me. So in the afternoon; Allah Apostle got up and addressed the people. He praised Allah as He deserved and then said; Amma badu ! The nations prior to you were destroyed because if a noble amongst them stole; they used to excuse him; and if a poor person amongst them stole; they would apply Allahs Legal Punishment to him. By Him in Whose Hand Muhammad soul is; if Fatima; the daughter of Muhammad stole; I would cut her hand. Then Allah Messenger ﷺ gave his order in the case of that woman and her hand was cut off. Afterwards her repentance proved sincere and she got married. SahihAlBukhari-017-001-6817Narrated Ibn Abbas: The law of Qisas i.e. equality in punishment was prescribed for the children of Israel; but the Diya i.e. blood money was not ordained for them. So Allah said to this Nation i.e. Muslims : O you who believe! The law of AlQisas i.e. equality in punishment is prescribed for you in cases of murder: The free for the free; the slave for the slave; and the female for the female. But if the relatives or one of them of the killed person forgive their brother i.e. the killers something of Qisas i.e. not to kill the killer by accepting blood money in the case of intentional murder --then the relatives of the killed person should demand blood-money in a reasonable manner and the killer must pay with handsome gratitude. This is an allevitation and a Mercy from your Lord; in comparison to what was prescribed for the nations before you. SahihAlBukhari-017-001-6819Narrated Anas: That his aunt; AlRubai broke an incisor tooth of a girl. My aunt family requested the girl relatives for forgiveness but they refused; then they proposed a compensation; but they refused. Then they went to Allah Messenger ﷺ and refused everything except AlQisas i.e. equality in punishment. So Allah Apostle passed the judgment of AlQisas i.e. equality of punishment. Anas Bin AlNadr said; O Allah Messenger ﷺ ! Will the incisor tooth of AlRubai be broken? No; by Him Who sent you with the Truth; her incisor tooth will not be broken. Allah Messenger ﷺ said; O Anas! SahihAlBukhari-017-001-6882Narrated Alqama Bin Waqqas: Marwan said to his gatekeeper; Go to Ibn Abbas; O Rafi; and say; If everybody who rejoices in what he has done; and likes to be praised for what he has not done; will be punished; then all of us will be punished. Ibn Abbas said; What connection have you with this case? It was only that the Prophet ﷺ called the Jews and asked them about something; and they hid the truth and told him something else; and showed him that they deserved praise for the favor of telling him the answer to his question; and they became happy with what they had concealed.
