Ye are one from another: Wed them with the leave of their owners, and give them their dowers, according to what is reasonable: They should be chaste, not lustful, nor taking paramours: when they are taken in wedlock, if they fall into shame, their punishment is half that for free women. This (permission) is for those among you who fear sin; but it is better for you that ye practise self-restraint. And Allah is Oft-forgiving, Most Merciful.
Surat AlBaqara Ayah 221Surat AlBaqara0.4887وَلَا تَنْكِحُوا الْمُشْرِكَاتِ حَتَّى يُؤْمِنَّ وَلَأَمَةٌ مُؤْمِنَةٌ خَيْرٌ مِنْ مُشْرِكَةٍ وَلَوْ أَعْجَبَتْكُمْ وَلَا تُنْكِحُوا الْمُشْرِكِينَ حَتَّى يُؤْمِنُوا وَلَعَبْدٌ مُؤْمِنٌ خَيْرٌ مِنْ مُشْرِكٍ وَلَوْ أَعْجَبَكُمْ أُولَئِكَ يَدْعُونَ إِلَى النَّارِ وَاللَّهُ يَدْعُو إِلَى الْجَنَّةِ وَالْمَغْفِرَةِ بِإِذْنِهِ وَيُبَيِّنُ آيَاتِهِ لِلنَّاسِ لَعَلَّهُمْ يَتَذَكَّرُونَDo not marry unbelieving women (idolaters), until they believe: A slave woman who believes is better than an unbelieving woman, even though she allures you. Nor marry (your girls) to unbelievers until they believe: A man slave who believes is better than an unbeliever, even though he allures you. Unbelievers do (but) beckon you to the Fire. But Allah beckons by His Grace to the Garden (of bliss) and forgiveness, and makes His Signs clear to mankind: That they may celebrate His praise.

They told me to greet her on their behalf and to ask her about the offering of the two rakat after the Asr prayer and to say to her; We were informed that you offer those two rakat and we were told that the Prophet had forbidden offering them. Ibn Abbas said; I along with Umar Bin AlKhattab used to beat the people whenever they offered them. I went to Aisha and told her that message. Aisha said; Go and ask Umm Salamah about them. So I returned and informed them about her statement. They then told me to go to Umm Salamah with the same question with which t sent me to Aisha. Umm Salamah replied; I heard the Prophet ﷺ forbidding them. Later I saw him offering them immediately after he prayed the Asr prayer. He then entered my house at a time when some of the Ansari women from the tribe of Bani Haram were sitting with me; so I sent my slave girl to him having said to her; Stand beside him and tell him that Umm Salamah says to you; O Allah Messenger ﷺ ! I have heard you forbidding the offering of these two rakat after the Asr prayer but I have seen you offering them. If he waves his hand then wait for him. The slave girl did that. The Prophet ﷺ beckoned her with his hand and she waited for him. When he had finished the prayer he said; O daughter of Bani Umaiya! You have asked me about the two rakat after the Asr prayer. The people of the tribe of Abd AlQais came to me and made me busy and I could not offer the two rakat after the Zuhr prayer. SahihAlBukhari-017-001-1208Narrated Abu Huraira: While we were with Allah Messenger ﷺ a bedouin got up and said; O Allah Messenger ﷺ ! Settle my case according to Allah Book Laws. Then his opponent got up and said; O Allah Messenger ﷺ ! He has said the truth! Settle his case according to Allah Book Laws. and allow me to speak; He said; My son was a laborer for this man and he committed illegal sexual intercourse with his wife. The people told me that my son should be stoned to death but I ransomed him with one-hundred sheep and a slave girl. Then I asked the religious learned people and they told me that his wife should be stoned to death and my son should receive one-hundred lashes and be sentenced to one year of exile. The Prophet ﷺ said; By Him in Whose Hands my life is; I will judge between you according to Allah Book Laws : As for the slave girl and the sheep; they are to be returned; and as for your son; he shall receive onehundred lashes and will be exiled for one year. You; O Unais! addressing a man from Bani Aslam; Go tomorrow morning to the wife of this man and if she confesses; then stone her to death. So in the year of Conquest of Mecca; Saad took him and said. This is my brother son whom my brother has asked me to take into my custody. Abd Bin Zama got up before him and said; He is my brother and the son of the slave girl of my father; and was born on my father bed. So they both submitted their case before Allah Apostle. Saad said; O Allah Messenger ﷺ ! This boy is the son of my brother and he entrusted him to me. Abd Bin Zama said; This boy is my brother and the son of the slave girl of my father; and was born on the bed of my father. Allah Messenger ﷺ said; The boy is for you; O Abd Bin Zama! Then Allah Apostle further said; The child is for the owner of the bed; and the stone is for the adulterer; He then said to Sauda bint Zama; Veil screen yourself before him; when he saw the child resemblance to Utba. SahihAlBukhari-017-001-1498Narrated Aisha: After the slanderers had given a forged statement against her; Allah Messenger ﷺ called Ali Bin Abi Talib and Usama Bin Zaid when the Divine Inspiration was delayed. He wanted to ask them and consult them about the question of divorcing me. Usama gave his evidence that was based on what he knew about my innocence; but Ali said; Allah has not put restrictions on you and there are many women other than her. Furthermore you may ask the slave girl who will tell you the truth. So the Prophet ﷺ asked Barira my salve girl ; Have you seen anything that may arouse your suspicion? She replied; I have not seen anything more than that she is a little girl who sleeps; leaving the dough of her family unguarded that the domestic goats come and eat it. Then the Prophet ﷺ stood on the pulpit and said; O Muslims! Who will help me against the man who has harmed me by slandering my wife? By Allah; I know nothing about my family except good. The narrator added: Then the Prophet ﷺ mentioned the innocence of Aisha. This Verse refers to the orphan girl who is under the guardianship of her guardian who likes her beauty and wealth and wishes to marry her and curtails her Mahr. The people asked for the verdict of Allah Messenger ﷺ after that; so Allah revealed: They ask your instruction concerning the women... whom you desire to marry. 4.127 So Allah revealed to them that if the orphan girl had beauty and wealth; they desired to marry her and for her family status. They can only marry them if they give them their full Mahr. And if they had no desire to marry them because of their lack of wealth and beauty; they would leave them and marry other women. So; as they used to leave them; when they had no interest; in them; they were forbidden to marry them when they had such interest; unless they treated them justly and gave them their full Mahr Apostle said; If at all there is evil omen; it is in the horse; the woman and the house. a lady is to be warded off. SahihAlBukhari-017-001-3548Narrated Anas: The Prophet ﷺ stayed for three days at a place between Khaibar and Medina; and there he consummated his marriage with Safiya bint Huyay. SahihMuslim-017-001-18036It has been narrated on the authority of Salama Bin AlAkwa who said: We fought against the Fazara; and Abu Bakr was the commander over us. He had been appointed by the Messenger of Allah ﷺ. When we were only at an hour distance from the water of the enemy; Abu Bakr ordered us to attack. We made a halt during the last part of the night to rest and then we attacked from all sides and reached their watering-place where a battle was fought. Some of the enemies were killed and some were taken prisoners. I saw a group of persons that consisted of women and children. I was afraid lest they should reach the mountain before me; so I shot an arrow between them and the mountain. When they saw the arrow; they stopped. So I brought them; driving them along. Among them was a woman from Banu Fazara. She was wearing a leather coat. With her was her daughter who was one of the prettiest girls in Arabia. I drove them along until I brought them to Abu Bakr who bestowed that girl upon me as a prize. So we arrived in Medina. I had not yet disrobed her when the Messenger of Allah ﷺ met me in the street and said: Give me that girl; O Salama. I said: Messenger of Allah; she has fascinated me. I had not yet disrobed her. When on the next day the Messenger of Allah ﷺ again met me in the street; he said: O Salama; give me that girl; may God bless your father. I said: She is for you; Messenger of Allah! By Allah. I have not yet disrobed her. SahihMuslim-017-001-19795Anas Bin Malik reported that there was an orphan girl with Umm Sulaim who was the mother of Anas. She said: Allah Apostle ﷺ has invoked curse upon me that I should not grow in age and thus I would never grow in age; or she said; in my length of life. Umm Sulaim went out wrapping her head-dress hurriedly until she met Allah Messenger ﷺ. He said to her: Umm Sulaim; what is the matter with you? She said: Allah Apostle; you invoked curse upon my orphan girl. He said: Umm Sulaim; what is that? She said: She the orphan girl states you have cursed her saying that she might not grow in age or grow in life. Allah Messenger ﷺ smiled and then said: Umm Sulaim; dont you know that I have made this term with my Lord. Allah Apostle ﷺ moved in the narrow street of Khaibar and we rode so close to each other in the street that my knee touched the leg of Allah Apostle ﷺ. As he entered the habitation he called: Allahu Akbar Allah is the Greatest. Khaibar is ruined. And when we get down in the valley of a people evil is the morning of the warned ones. He repeated it thrice. In the meanwhile the people went out for their work; and said: By Allah; Muhammad has come. Abd AlAziz or some of our companions said: Muhammad and the army have come. He said: We took it the territory of Khaibar by force; and there were gathered the prisoners of war. There came Dihya and he said: Messenger of Allah; bestow upon me a girl from among the prisoners. He said: Go and get any girl. He made a choice for Safiya daughter of Huyay Bin Akhtab. There came a person to Allah Apostle ﷺ and said: Apostle of Allah; you have bestowed Safiya bint Huyay; the chief of Quraidha and AlNadir; upon Dihya and she is worthy of you only. He said: Call him along with her. So he came along with her. When Allah Apostle ﷺ saw her he said: Take any other woman from among the prisoners. He the narrator said: He the Holy Prophet then granted her emancipation and married her. Thabit said to him: Abu Hamza; how much dower did he the Holy Prophet give to her? He said: He granted her freedom and then married her. On the way Umm Sulaim embellished her and then sent her to him the Holy Prophet at night. He said: My son was a laborer serving this man; and he committed Zina with his wife. They told me that my son was to be stoned to death; but I ransomed him with one hundred sheep and a slave girl of mine. Then I asked the people of knowledge; who told me that my son was to be given one hundred lashes and exiled for a year; and that his the mans wife was to be stoned to death. The Messenger of Allah SAWSYMOBOL said: By the One in Whose hand is my soul; I will pass judgment between you according to the Book of Allah. As for your sheep and your slave girl; take them back. She said: By Allah; I did not call you to bear witness; rather I called you to have intercourse with me; or to drink a cup of this wine; or to kill this boy. He said: Pour me a cup of this wine. SunanAlNasai-017-001-14551Urwah Bin AlZubair narrated that he asked Aisha about the saying of Allah; the Mighty and Sublime: And if you fear that you shall not be able to deal justly with the orphan girls then marry other women of your choice. She said: O son of my sister; this refers to a female orphan who is in the care of her guardian; and her wealth is joined to his; and he is attracted to her wealth and her beauty. So her guardian wants to marry her without being fair with regard to her dowry; and without giving her what someone else would give her. So they were forbidden to marry them unless they were fair to them and gave them the highest possible dowry that is customarily given; and they were commanded to marry other women of their choice. Urwah said: Aisha said: Then later on; Allah; the Mighty and Sublime; revealed concerning them: They ask your legal instruction concerning women; say: Allah instructs you about them; and about what is recited unto you in the Book concerning the orphan girls whom you give not the prescribed portions and yet whom you desire to marry. Aisha said: What Allah; Most High; mentioned here that is recited in the Book is the first Verse in which it says: And if you fear that you shall not be able to deal justly with orphan girls then marry other women of your choice. Aisha said: What is referred to in the other Verse -and yet whom you desire to marry- is the desire of one of you not to marry orphan girl who is under his care if she is lacking in wealth and beauty. The Prophet of Allah passed through the lane of Khaibar quickly; and my knee was touching the thigh of the Messenger of Allah; and I could see the whiteness of the thigh of the Prophet. When he entered the town he said: Allahu Akbar; Khaibar is destroyed! Whenever we approach a hostile nation to fight; evil will be the morning for those who have been warned. He said this three times. The people came out for their work. One of the narrators Abd AlAziz said: They said: Muhammad has come ! Abd AlAziz said: Some of our companions said: With his army. We conquered Khaibar and gathered the captives. Dihyah came and said: O Prophet of Allah; give me a slave girl from among the captives. He said: Go and take a slave girl. He took Safiyah bint Huyay. Then a man came to the Prophet and said: O Messenger of Allah; you gave Dihyah Safiyah bint Huyay; and she is the chief mistress of Quraidha h and AlNadir; and she is fit for no one but you. He said: Call him to bring her. When the Prophet saw her; he said: Take any other slave girl from among the captives. He said: The Prophet of Allah set her free and married her. One of the narrators Thabit said to him: O Abu Hamzah; what dowry did he give her? He Anas said: Herself; he set her free and married her. He said: While on the road; Umm Sulaim fitted her out and presented her to him in the night; and the following morning he was a bridegroom. He said: Whoever has anything; let him bring it. They said: Convey our regards to her from all of us and ask her about the two rakahs after the Asr prayer; and tell her that we have been informed that she prays them; and we are told that the Messenger of Allah ﷺ prohibited them. I entered upon her and told her that for which they had sent me to her. She said: Ask Umm Salamah. I returned to them Ibn Abbas and others and informed them about her opinion. They sent me back to Umm Salamah with the same mission for which they had sent me to Aishah. Umm Salamah said: I heard the Messenger of Allah ﷺ prohibiting them; but later on I saw him praying them. When he prayed them; he had offered the Asr prayer. He then came to me while a number of women from Banu Haram from the Ansar were sitting with me. He prayed these two rakahs. I sent a slave girl to him and I told her: Stand beside him and tell him that Umm Salamah has asked: Messenger of Allah ﷺ ; I heard you prohibiting these two rakahs after the afternoon prayer but I see you praying them yourself. If he makes a sign with his hand; step backward from him. The slave girl did so. When he finished prayer; he said: O daughter of Abu Umayah; you asked about the praying of two rakahs after the Asr prayer; in fact; some people of Abd AlQais has come to me with the news that their people had embraced Islam. They hindered me from praying the two rakahs after Zuhr prayer. Malik said that a man who bought a slave- girl on condition that he did not sell her; give her away; or do something of that nature; was not to have intercourse with her. That was because he was not permitted to sell her or to give her away; so if he did not own that from her; he did not have complete ownership of her because an exception had been made concerning her by the hand of someone else. She therefore asked him to divorce her. He divorced her once; and then returned to her; and still preferred the young girl; and she asked him to divorce her. He said; What do you want? There is only one divorce left. If you like; continue and put up with what you see of preference; and if you like; I will separate from you. She said; I will continue in spite of the preference. He kept her in spite of that. He said; There is no harm in a man having intercourse with two of his slave girls before he does ghusl. It is disapproved of; however; to go to a freewoman on another day. There is no harm in making love first to one slave girl and then to another when one is junub. Malik was asked about a man who was junub and water was put down for him to do ghusl with.Then he forgot and put his finger into it to find out whether it was hot or cold.
