But I intend not to place thee under a difficulty: thou wilt find me, indeed, if Allah wills, one of the righteous."

This day have those who reject faith given up all hope of your religion: yet fear them not but fear Me. This day have I perfected your religion for you, completed My favour upon you, and have chosen for you Islam as your religion. But if any is forced by hunger, with no inclination to transgression, Allah is indeed Oft-forgiving, Most Merciful.
Surat AlBaqara Ayah 196Surat AlBaqara-0.08687وَأَتِمُّوا الْحَجَّ وَالْعُمْرَةَ لِلَّهِ فَإِنْ أُحْصِرْتُمْ فَمَا اسْتَيْسَرَ مِنَ الْهَدْيِ وَلَا تَحْلِقُوا رُءُوسَكُمْ حَتَّى يَبْلُغَ الْهَدْيُ مَحِلَّهُ فَمَنْ كَانَ مِنْكُمْ مَرِيضًا أَوْ بِهِ أَذًى مِنْ رَأْسِهِ فَفِدْيَةٌ مِنْ صِيَامٍ أَوْ صَدَقَةٍ أَوْ نُسُكٍ فَإِذَا أَمِنْتُمْ فَمَنْ تَمَتَّعَ بِالْعُمْرَةِ إِلَى الْحَجِّ فَمَا اسْتَيْسَرَ مِنَ الْهَدْيِ فَمَنْ لَمْ يَجِدْ فَصِيَامُ ثَلَاثَةِ أَيَّامٍ فِي الْحَجِّ وَسَبْعَةٍ إِذَا رَجَعْتُمْ تِلْكَ عَشَرَةٌ كَامِلَةٌ ذَلِكَ لِمَنْ لَمْ يَكُنْ أَهْلُهُ حَاضِرِي الْمَسْجِدِ الْحَرَامِ وَاتَّقُوا اللَّهَ وَاعْلَمُوا أَنَّ اللَّهَ شَدِيدُ الْعِقَابِAnd complete the Hajj or 'umra in the service of Allah. But if ye are prevented (From completing it), send an offering for sacrifice, such as ye may find, and do not shave your heads until the offering reaches the place of sacrifice. And if any of you is ill, or has an ailment in his scalp, (Necessitating shaving), (He should) in compensation either fast, or feed the poor, or offer sacrifice; and when ye are in peaceful conditions (again), if any one wishes to continue the 'umra on to the hajj, He must make an offering, such as he can afford, but if he cannot afford it, He should fast three days during the hajj and seven days on his return, Making ten days in all. This is for those whose household is not in (the precincts of) the Sacred Mosque. And fear Allah, and know that Allah Is strict in punishment.
Surat AlBaqara Ayah 187Surat AlBaqara0.02287أُحِلَّ لَكُمْ لَيْلَةَ الصِّيَامِ الرَّفَثُ إِلَى نِسَائِكُمْ هُنَّ لِبَاسٌ لَكُمْ وَأَنْتُمْ لِبَاسٌ لَهُنَّ عَلِمَ اللَّهُ أَنَّكُمْ كُنْتُمْ تَخْتَانُونَ أَنْفُسَكُمْ فَتَابَ عَلَيْكُمْ وَعَفَا عَنْكُمْ فَالْآنَ بَاشِرُوهُنَّ وَابْتَغُوا مَا كَتَبَ اللَّهُ لَكُمْ وَكُلُوا وَاشْرَبُوا حَتَّى يَتَبَيَّنَ لَكُمُ الْخَيْطُ الْأَبْيَضُ مِنَ الْخَيْطِ الْأَسْوَدِ مِنَ الْفَجْرِ ثُمَّ أَتِمُّوا الصِّيَامَ إِلَى اللَّيْلِ وَلَا تُبَاشِرُوهُنَّ وَأَنْتُمْ عَاكِفُونَ فِي الْمَسَاجِدِ تِلْكَ حُدُودُ اللَّهِ فَلَا تَقْرَبُوهَا كَذَلِكَ يُبَيِّنُ اللَّهُ آيَاتِهِ لِلنَّاسِ لَعَلَّهُمْ يَتَّقُونَPermitted to you, on the night of the fasts, is the approach to your wives. They are your garments and ye are their garments. Allah knoweth what ye used to do secretly among yourselves; but He turned to you and forgave you; so now associate with them, and seek what Allah Hath ordained for you, and eat and drink, until the white thread of dawn appear to you distinct from its black thread; then complete your fast Till the night appears; but do not associate with your wives while ye are in retreat in the mosques. Those are Limits (set by) Allah: Approach not nigh thereto. Thus doth Allah make clear His Signs to men: that they may learn self-restraint.
Surat AlMaidah Ayah 6Surat AlMaidah0.037112يَا أَيُّهَا الَّذِينَ آمَنُوا إِذَا قُمْتُمْ إِلَى الصَّلَاةِ فَاغْسِلُوا وُجُوهَكُمْ وَأَيْدِيَكُمْ إِلَى الْمَرَافِقِ وَامْسَحُوا بِرُءُوسِكُمْ وَأَرْجُلَكُمْ إِلَى الْكَعْبَيْنِ وَإِنْ كُنْتُمْ جُنُبًا فَاطَّهَّرُوا وَإِنْ كُنْتُمْ مَرْضَى أَوْ عَلَى سَفَرٍ أَوْ جَاءَ أَحَدٌ مِنْكُمْ مِنَ الْغَائِطِ أَوْ لَامَسْتُمُ النِّسَاءَ فَلَمْ تَجِدُوا مَاءً فَتَيَمَّمُوا صَعِيدًا طَيِّبًا فَامْسَحُوا بِوُجُوهِكُمْ وَأَيْدِيكُمْ مِنْهُ مَا يُرِيدُ اللَّهُ لِيَجْعَلَ عَلَيْكُمْ مِنْ حَرَجٍ وَلَكِنْ يُرِيدُ لِيُطَهِّرَكُمْ وَلِيُتِمَّ نِعْمَتَهُ عَلَيْكُمْ لَعَلَّكُمْ تَشْكُرُونَO ye who believe! when ye prepare for prayer, wash your faces, and your hands (and arms) to the elbows; Rub your heads (with water); and (wash) your feet to the ankles. If ye are in a state of ceremonial impurity, bathe your whole body. But if ye are ill, or on a journey, or one of you cometh from offices of nature, or ye have been in contact with women, and ye find no water, then take for yourselves clean sand or earth, and rub therewith your faces and hands, Allah doth not wish to place you in a difficulty, but to make you clean, and to complete his favour to you, that ye may be grateful.
Surat AlBaqara Ayah 185Surat AlBaqara0.1987شَهْرُ رَمَضَانَ الَّذِي أُنْزِلَ فِيهِ الْقُرْآنُ هُدًى لِلنَّاسِ وَبَيِّنَاتٍ مِنَ الْهُدَى وَالْفُرْقَانِ فَمَنْ شَهِدَ مِنْكُمُ الشَّهْرَ فَلْيَصُمْهُ وَمَنْ كَانَ مَرِيضًا أَوْ عَلَى سَفَرٍ فَعِدَّةٌ مِنْ أَيَّامٍ أُخَرَ يُرِيدُ اللَّهُ بِكُمُ الْيُسْرَ وَلَا يُرِيدُ بِكُمُ الْعُسْرَ وَلِتُكْمِلُوا الْعِدَّةَ وَلِتُكَبِّرُوا اللَّهَ عَلَى مَا هَدَاكُمْ وَلَعَلَّكُمْ تَشْكُرُونَRamadhan is the (month) in which was sent down the Qur'an, as a guide to mankind, also clear (Signs) for guidance and judgment (Between right and wrong). So every one of you who is present (at his home) during that month should spend it in fasting, but if any one is ill, or on a journey, the prescribed period (Should be made up) by days later. Allah intends every facility for you; He does not want to put to difficulties. (He wants you) to complete the prescribed period, and to glorify Him in that He has guided you; and perchance ye shall be grateful.

SahihAlBukhari-017-001-5013Narrated Abu Mousa: The Prophet ﷺ said; The example of Muslims; Jews and Christians is like the example of a man who employed laborers to work for him from morning till night for specific wages. They worked till midday and then said; We do not need your money which you have fixed for us and let whatever we have done be annulled. The man said to them; Dont quit the work; but complete the rest of it and take your full wages. But they refused and went away. The man employed another batch after them and said to them; Complete the rest of the day and yours will be the wages I had fixed for the first batch. So; they worked till the time of Asr prayer. Then they said; Let what we have done be annulled and keep the wages you have promised us for yourself. The man said to them; Complete the rest of the work; as only a little of the day remains; but they refused. Thereafter he employed another batch to work for the rest of the day and they worked for the rest of the day till the sunset; and they received the wages of the two former batches. The Prophet ﷺ ordered me to undo and comb my head hair and assume the lhram for Hajj only and leave the Umra. I did the same till I completed the Hajj. SahihAlBukhari-017-001-6479Narrated Sahl Bin Abi Hathma: describing the Fear prayer : The Imam stands up facing the Qibla and one batch of them i.e. the army out of the two prays along with him and the other batch faces the enemy. The Imam offers one raka with the first batch they themselves stand up alone and offer one bowing and two prostrations while they are still in their place; and then go away to relieve the second batch; and the second batch comes and takes the place of the first batch in the prayer behind the Imam and he offers the second raka with them. So he completes his two-rakat and then the second batch bows and prostrates two prostrations i.e. complete their second raka and thus all complete their prayer. SahihAlBukhari-017-001-6846Narrated Mujahi: regarding the Verse :- Those of you who die and leave wives behind. They - their wives - shall wait as regards their marriage for four months and ten days. 2.234 The widow; according to this Verse; was to spend this period of waiting with her husband family; so Allah revealed: Those of you who die and leave wives i.e. widows should bequeath for their wives; a year maintenance and residences without turning them out; but if they leave their residence ; there is no blame on you for what they do with themselves provided it is honorable. i.e. lawful marriage 2.240. So Allah entitled the widow to be bequeathed extra maintenance for seven months and twenty nights; and that is the completion of one year. If she wished she could stay in her husband home according to the will; and she could leave it if she wished; as Allah says:..without turning them out; but if they leave the residence ; there is no blame on you. So the Idda i.e. four months and ten days as it is obligatory for her. Ata said: Ibn Abbas said; This Verse; i.e. the Statement of Allah:..without turning them out.. cancelled the obligation of staying for the waiting period in her dead husband house; and she can complete this period wherever she likes. Ata aid: If she wished; she could complete her Idda by staying in her dead husband residence according to the will or leave it according to Allah Statement:- There is no blame on you for what they do with themselves. Ata added: Later the regulations of inheritance came and abrogated the order of the dwelling of the widow in her dead husband house ; so she could complete the Idda wherever she likes. And it was no longer necessary to provide her with a residence. SahihAlBukhari-017-001-968Narrates Ibn Seereen: Abu Huraira said; Allah Messenger ﷺ led us in one of the two Isha prayers Abu Huraira named that prayer but I forgot it. Abu Huraira added; He prayed two rakat and then finished the prayer with Taslim. He stood up near a piece of wood Lying across the Masjid and leaned on it in such a way as if he was angry. Then he put his right hand over the left and clasped his hands by interlacing his fingers and then put his J right cheek on the back of his left hand. The people who were in haste left the Masjid through its gates. They wondered whether the prayer was reduced. And amongst them were Abu Bakr and Umar but they hesitated to ask the Prophet. A long-handed man called Dhu AlYadain asked the Prophet; O Allah Messenger ﷺ ! Have you forgotten or has the prayer been reduced? The Prophet ﷺ replied; I have neither forgotten nor has the prayer been reduced The Prophet ﷺ added; Is what Dhul Yadain has said true? They the people said; Yes; it is true. The Prophet ﷺ stood up again and led the prayer; completing the remaining prayer; forgotten by him; and performed Taslim; and then said; Allahu Akbar. And then he did a prostration as he used to prostrate or longer than that. He then raised his head saying; Allahu Akbar; he then again said; Allahu Akbar; and prostrated as he used to prostrate or longer than that. Then he raised his head and said; Allahu Akbar. The subnarrator added; I think that they asked Ibn Seereen whether the Prophet ﷺ completed the prayer with Taslim. SahihMuslim-017-001-21880Jabir reported that the sun eclipsed during the lifetime of the Messenger of Allah ﷺ on that very day when Ibrahim the Prophet son died. The Apostle of Allah ﷺ stood up and led people in two rakahs of prayer with six ruku and four prostrations. He commenced the prayer with takbir Allah-o-Akbar and then recited and prolonged his recital. He then bowed nearly the length of time that he stood up. He then raised his head from the ruku and recited but less than the first recital. He then bowed to the length of time that he stood up. He then raised his head from the ruku and again recited but less than the second recital. He then bowed to the length of time that he stood up. He then lifted his head from the ruku. He then fell in prostration and observed two prostrations. He stood up and then bowed; observing six ruku like it; without completing the rakah in them; except this difference that the first qiyam of ruku was longer than the later one; and the ruku was nearly of the same length as prostration. He then moved backward and the rows behind him also moved backward till we reached the extreme Abu Bakr said: till he reached near the women He then moved forward and the people also moved forward along with him till he stood at his original place of worship. He then completed the prayer as it was required to complete and the sun brightened and he said: O people! verily the sun and the moon are among the signs of Allah and they do not eclipse at the death of anyone among people Abu Bakr said: On the death of any human being. So when you see anything like it of the nature of eclipse ; pray till it is bright. There is nothing which you have been promised in the next world but I have seen it in this prayer of mine. Hell was brought to me as you saw me moving back on account of fear lest its heat might affect me; and I saw the owner of the curved staff who dragged his intestines in the fire; and he used to steal the belongings of the pilgrims with his curved staff. If he the owner of the staff became aware; he would say: It got accidentally entangled in my curved staff; but if he was unaware of that; he would take that away. I also saw in it in Hell the owner of a cat whom she had tied and did not feed her nor set her free so that she could eat the creatures of the earth; till the cat died of starvation. Paradise was brought to me; and it was on that occasion that you saw me moving forward till I stood at my place of worship. I stretched my hand as I wanted to catch hold of its fruits so that you may see them. Then I thought of not doing it. She Aisha said: I did accordingly. He thought if it stops proceeding further how he would be able to take it; along with him and said: I would definitely find out the religious verdict about it. When he lifted his head; he saw that the sun had arisen; he then said: Proceed on. He travelled along with us till the sun shone brightly. He came down from his camel and led us in the morning prayer. A person; however; remained away from the people and did not say; prayer along with us. After having completed the prayer; the Messenger of Allah ﷺ said to him: O; so and so; what prevented you from observing prayer with us? He said: Apostle of Allah! I was not in a state of purity. The Messenger of Allah ﷺ ordered him arid lie performed Tayammum with dust and said prayer. He then urged me to go ahead immediately along with other riders to find out water; for we felt very thirsty. We were traveling when we came across a woman who was sitting on a camel with her feet hanging over two leathern water bags. We said to her: How far is water available? She; said: Far; very far; very far. You cannot get water. We again said: How much distance is there between the residence of your family and water? She said: It is a day and night journey. We said to her: You go to the Messenger of Allah ﷺ. She said: Who is the Messenger of Allah? We somehow or the other managed to bring her to the Messenger of Allah ﷺ and he asked about her; and she informed him as she had informed us that she was a widow having orphan children. He ordered that her camel should be made to kneal down and he gargled in the opening of her leathern water-bag. The camel was then raised up and we forty thirsty men drank water till we were completely satiated; and we filled up all leathern water-bags and water-skins that we had with us and we washed our companions; but we did not make any camel drink; and the leathern water-bags were about to burst on account of excess of water. He then said: Bring whatever you have with you. So we collected the bits of estable things and dates and packed them up in a bundle; and said to her: Take it away. This is meant for your children; and know that we have not its any way done any loss to your water. W hen she came to her family she said: I have met the greatest magician amongst human beings; or he is an apostle; as he claims to be; and she then narrated what had happened and Allah guided aright those people through that woman. She narrated to us that her husband had divorced her three times; and he did not leave her with anywhere to live nor any wealth. She said: He left ten Aqfizah for me with the son of his uncle: five were of barley; five of wheat. She said: I went to the Messenger of Allah and mentioned that to him. She said: He said: He is correct. She said: So he ordered me to complete my Iddah in the home of Umm Sharik. But then the Messenger of Allah said to me: Umm Sharik home is visited by Muhajirun; so spend your Iddah in the home of Ibn Umm Maktum; for there you can remove your garments and he will not see you. Then when your Iddah is completed and someone proposed to you come to me. So when my Iddah completed. Abu Jahm and Muawiyah proposed to me. She said: I went to the Messenger of Allah and mentioned that to him; and he said: As for Muawiyah; he is a man with no wealth; and as for Abu Jahm he is a man who is harsh with women. She said: Then Usamah Bin Zaid proposed to me; and he married me. SunanAlNasai-017-001-16862It was narrated that Rifaah Bin Rafi said: While the Messenger of Allah ﷺ was sitting with us around him; a man came in; turned towards the Qiblah and prayed. When he had finished his prayer; he came and greeted the Messenger of Allah ﷺ and the people with Salam. The Messenger of Allah ﷺ said to him: And also to you. Go and pray; for you have not prayed. So he went and prayed; and the Messenger of Allah ﷺ started watching him; and he the man did not know what was wrong with it. So he should wash his face; his arms up to the elbows; and wipe his head; and wash his feet up to the ankles. Then he should magnify Allah SWT and praise Him and glorify Him. - One of the narrators Hammam said: I heard him say: He should praise Allah and glorify Him and magnify Him. The Messenger of Allah ﷺ made Bani Malik stay in a tent of his. Mousaddad version says: He was in the deputation of Thaqif which came to the Messenger of Allah ﷺ. He used to visit and have a talk with us every day after the night prayer. The version of Abu Saeed says: He remained standing for such a long time talking to us that he put his weight sometimes on one leg and sometimes on the other due to his long stay. He mostly told us how his people; the Quraysh; behaved with him. He would say: We were not equal; we were weak and degraded at Mecca according to Mousaddad version. When we came over to Medina the fighting began between us; sometimes we overcome them and at other times they overcome us. One night he came late and did not come at the time he used to come. We asked him: You came late tonight? He said: I could not recite the fixed part of the Quran that I used to recite every day. I disliked to come till I had completed it. Aws said: I asked the companions of the Messenger of Allah ﷺ : How do you divide the Quran for daily recitation? He led those who were with him in one rakah and remained standing in his place and they completed the second rakah by themselves. Then they turned away and arrayed before the enemy. The other section should stand facing the enemy. The imam should perform bowing and prostrate himself along with those who are with him. He then should stand after prostration and; when he stands straight; he should remain standing. They the people should in the meantime complete their remaining rakah i.e. the second one. They they should utter the salutation; and turn away while the imam should remain standing. They should go before the enemy. SunanAbuDawoud-017-001-27835Narrated Rifaah Ibn Rafi: This version of Hadith No 856 adds: The Messenger of Allah ﷺ said: The prayer of any of you is not complete until he performs ablution perfectly; as Allah; the Exalted; has ordered you. He should wash his face and hands up to the elbows; and wipe his head and wash his feet up to the ankles. Then he should exalt Allah and praise Him. Then he should recite the Quran as much as it is convenient for him. Narrator then narrated the tradition like Hammads; No. 856. He said: He then utter the takbir and prostration himself so that his face is at rest. Hammam sub-narrator said: Sometimes he reported: So that his forehead is at rest on the ground; and his joints return to their places and are loosened. Then he should say the takbir and then sit right on his hips and erect his back. He described the nature of prayer in this way by offering four rakahs until he finished it. MuwataMalik-017-001-34745Yahya said that Malik said; When the relatives of the deceased accept the blood-money then it is inherited according to the Book of Allah. Daughters of the dead man inherit and so do sisters; and whichever women would inherit from him ordinarily. If the women do not take all his inheritance; then what remains goes to the agnatic relations who most deserve to inherit from him in conjunction with the women. Malik said; When one of the heirs of a man killed by mistake attempts to take his due from the blood-money while his companions are absent; he may not do that; and he has no right to any of the blood-money; however large or small; unless the qasama has been completed by him. If he swears fifty oaths then he has the right to his portion of the blood-money. That is because the blood-money is not established as due without there being fifty oaths; and the blood- money is not established as due unless the responsibility for the blood is established. If any one of the heirs comes after that he swears a number of the oaths commensurate with his fraction of the inheritance and takes his right until all the heirs exact their complete right. If a maternal uncle comes he has one sixth and must swear one sixth of the fifty oaths. So whoever swears may take his due from the blood-money and whoever abstains annuls his right. If one of the heirs is absent or is a child who has not reached puberty; those who are present swear fifty oaths and if the one who was absent comes after that or the child reaches puberty; they swear. and they swear according to their due of the blood-money and according to their shares of inheritance from it. MuwataMalik-017-001-34972Malik related to me from Humayd Ibn Qays AlMakki that a son of AlMutawakkil had a mukatab who died at Makka and left enough to pay the rest of his kitaba and he owed some debts to people. He also left a daughter. The governor of Makka was not certain about how to judge in the case; so he wrote to Abd AlMalik Ibn Marwan to ask him about it. Abd AlMalik wrote to him; Begin with the debts owed to people; and then pay what remains of his kitaba. Then divide what remains of the property between the daughter and the master. Malik said; What is done among us is that the master of a slave does not have to give his slave a kitaba if he asks for it. I have not heard of any of the Imams forcing a man to give a kitaba to his slave. I heard that one of the people of knowledge; when someone asked about that and mentioned that Allah the Blessed; the Exalted; said; Give them their kitaba; if you know some good in them Surat 24 ayat 33 recited these two ayats; When you are free of the state of ihram; then hunt for game. Surat 5 ayat 3 When the prayer is finished; scatter in the land and seek Allah favour. Surat 62 ayat 10 Malik commented; It is a way of doing things for which Allah; the Mighty; the Majestic; has given permission to people; and it is not obligatory for them. Malik said; I heard one of the people of knowledge say about the word of Allah; the Blessed; the Exalted; Give them of the wealth which Allah has given you; that it meant that a man give his slave a kitaba and then reduce the end of his kitaba for him by some specific amount. Malik said; This is what I have heard from the people of knowledge and what I see people doing here. Malik said; I have heard that Abdullah Ibn Umar gave one of his slaves his kitaba for 35;000 dirhams; and then reduced the end of his kitaba by 5;000 dirhams. Malik said; What is done among us is that when a master gives a mukatab his kitaba; the mukatab property goes with him but his children do not go with him unless he stipulates that in his kitaba. Yahya said; I heard Malik say that if a mukatab whose master had given him a kitaba had a slave- girl who was pregnant by him; and neither he nor his master knew that on the day he was given his kitaba; the child did not follow him because he was not included in the kitaba. He belonged to the master. As for the slave-girl; she belonged to the mukatab because she was his property. Malik said that if a man and his wife son by another husband inherited a mukatab from the wife and the mukatab died before he had completed his kitaba; they divided his inheritance between them according to the Book of Allah. If the slave paid his kitaba and then died; his inheritance went to the son of the woman; and the husband had nothing of his inheritance. Malik said that if a mukatab gave his own slave a kitaba; the situation was looked at. If he wanted to do his slave a favour and it was obvious by his making it easy for him; that was not permitted. If he was giving him a kitaba from desire to find money to pay off his own kitaba; that was permitted for him. Malik said that if a man had intercourse with a mukataba of his and she became pregnant by him; she had an option. If she liked she could be an umm walad. If she wished; she could confirm her kitaba. If she did not conceive; she still had her kitaba. Malik said; The generally agreed on way of doing things among us about a slave who is owned by two men is that one of them does not give a kitaba for his share; whether or not his companion gives him permission to do so; unless they both write the kitaba together; because that alone would effect setting him free. If the slave were to fulfil what he had agreed on to free half of himself; and then the one who had given a kitaba for half of him was not obliged to complete his setting free; that would be in opposition to the words of the Messenger of Allah; may Allah bless him and grant him peace. If someone frees his share in a slave and has enough money to cover the full price of the slave; justly evaluated for him; he must give his partners their shares; so the slave is completely free. Malik said; If he is not aware of that until the mukatab has met the terms or before he has met them the owner who has written him the kitaba returns what he has taken from the mukatab to him; and then he and his partner divide him according to their original shares and the kitaba is invalid. He is the slave of both of them in his original state. Malik spoke about a mukatab who was owned by two men and one of them granted him a delay in the payment of the right which he was owed; and the other refused to defer it; and so the one who refused to defer the payment exacted his part of the due. Malik said that if the mukatab then died and left property which did not complete his kitaba; They divide it according to what they are still owed by him. Each of them takes according to his share. If the mukatab leaves more than his kitaba; each of them takes what remains to them of the kitaba; and what remains after that is divided equally between them. If the mukatab is unable to pay his kitaba fully and the one who did not allow him to defer his payment has exacted more than his associate did; the slave is still divided equally between them; and he does not return to his associates the excess of what he has exacted; because he only exacted his right with the permission of his associate. If one of them remits what is owed to him and then his associate exacts part of what he is owed by him and then the mukatab is unable to pay; he belongs to both of them. And the one who has exacted something does not return anything because he only demanded what he was owed. That is like the debt of two men in one writing against one man. One of them grants him time to pay and the other is greedy and exacts his due. Then the debtor goes bankrupt. MuwataMalik-017-001-34976Malik said; The best of what is said about a man who buys the mukatab of a man is that if the man wrote the slave kitaba for dinars or dirhams; he does not sell him unless it is for merchandise which is paid immediately and not deferred; because if it is deferred; it would be a debt for a debt. A debt for a debt is forbidden. He said; If the master gives a mukatab his kitaba for certain merchandise of camels; cattle; sheep; or slaves; it is more correct that the buyer buy him for gold; silver; or different goods than the ones his master wrote the kitaba for; and that must be paid immediately; not deferred. Malik said; The best of what I have heard about a mukatab when he is sold is that he is more entitled to buy his kitaba than the one who buys him if he can pay his master the price for which he was sold in cash. That is because his buying himself is his freedom; and freedom has priority over what bequests accompany it. If one of those who have written the kitaba for the mukatab sells his portion of him; so that a half; a third; a fourth; or whatever share of the mukatab is sold; the mukatab does not have the right of pre-emption in what is sold of him. That is because it is like the severance of a partner; and a partner can only make a settlement for a partner of the one who is mukatab with the permission of his partners because what is sold of him does not give him complete rights as a free man and his property is barred from him; and by buying part of himself; it is feared that he will become incapable of completing payment because of what he had to spend. That is not like the mukatab buying himself completely unless whoever has some of the kitaba remaining due to him gives him permission. If they give him permission; he is more entitled to what is sold of him. Malik said; Selling one of the instalments of a mukatab is not halal. That is because it Is an uncertain transaction. If the mukatab cannot pay it; what he owes is nullified. If he dies or goes bankrupt and he owes debts to people; then the person who bought his instalment does not take any of his portion with the creditors. The person who buys one of the instalments of the mukatab is in the position of the master of the mukatab. The master of the mukatab does not have a share with the creditors of the mukatab for what he is owed of the kitaba of his slave. It is also like that with the kharaj; a set amount deducted daily from the slave against his earnings ; which accumulates for a master from the earnings of his slave. The creditors of his slave do not allow him a share for what has accumulated for him from those deductions. Malik said; There is no harm in a mukatab paying off his kitaba with coin or merchandise other than the merchandise for which he wrote his kitaba if it is identical with it; on time for the instalment or delayed. Malik said that if a mukatab died and left an umm walad and small children by her or by someone else and they could not work and it was feared that they would be unable to fulfil their kitaba; the umm walad of the father was sold if her price would pay all the kitaba for them; whether or not she was their mother. They were paid for and set free because their father did not forbid her sale if he feared that he would be unable to complete his kitaba. If her price would not pay for them and neither she nor they could work; they all reverted to being slaves of the master. Malik said; What is done among us in the case of a person who buys the kitaba of a mukatab; and then the mukatab dies before he has paid his kitaba; is that the person who bought the kitaba inherits from him. If; rather than dying; the mukatab cannot pay; the buyer has his person. MuwataMalik-017-001-34978Malik related to me that he heard Rabia Ibn Abi Abdulrahman and others mention that AlFurafisa Ibn Umar AlHanafi had a mukatab who offered to pay him all of his kitaba that he owed. AlFurafisa refused to accept it and the mukatab went to Marwan Ibn AlHakam who was the amir of Madina and brought up the matter. Marwan summoned AlFurafisa and told him to accept. He refused. Marwan then ordered that the payment be taken from the mukatab and placed in the treasury. He said to the mukatab Go; you are free. When AlFurafisa saw that; he took the money. Malik said; What is done among us when a mukatab pays all the instalments he owes before their term; is that it is permitted to him. The master cannot refuse him that. That is because payment removes every condition from the mukatab as well as service and travel. The setting free of a man is not complete while he has any remaining slavery; and neither would his inviolability as a free man be complete and his testimony permitted and inheritance obliged and such things in that situation. His master must not make any stipulation of service on him after he has been set free. Malik said that it was permitted for a mukatab who became extremely ill and wanted to pay his master all his instalments because his heirs who were free would then inherit from him and he had no children with him in his kitaba; to do so; because by that he completed his inviolability as a free man; his testimony was permitted; and his admission of what he owed of debts to people was permitted. His bequest was permitted as well. MuwataMalik-017-001-35087Yahya related to me from Malik that he had heard that Muhammad Seereen used to say; Do not sell grain on the ears until it is white. Malik said; If someone buys food for a known price to be delivered at a stated date; and when the date comes; the one who owes the food says; I do not have any food; sell me the food which I owe you with delayed terms. The owner of the food says; This is not good; because the Messenger of Allah; may Allah bless him and grant him peace; forbade selling food until the deal was completed. The one who owes the food says to his creditor; Sell me any kind of food on delayed terms until I discharge the debt to you. This is not good because he gives him food and then he returns it to him. The gold which he gave him becomes the price of that which is his right against him and the food which he gave him becomes what clears what is between them. If they do that; it becomes the sale of food before the deal is complete. Malik spoke about a man who was owed food which he had purchased from a man and this man was owed the like of that food by another man. The one who owed the food said to his creditor; I will refer you to my debtor who owes me the same amount of food as I owe you; so that you may obtain the food which I owe you. Malik said; If the man who had to deliver the food; had gone out; and bought the food to pay off his creditor; that is not good. That is selling food before taking possession of it. If the food is an advance which falls due at that particular time; there is no harm in paying off his creditor with it because that is nota sale. It is not halal to sell food before receiving it in full since the Messenger of Allah; may Allah bless him and grant him peace; forbade that. However; the people of knowledge agree that there is no harm in partnership; transfer of responsibility and revocation in sales of food and other goods. Malik said; That is because the people of knowledge consider it as a favour rendered. They do not consider it as a sale. It is like a man lending light dirhams. He is then paid back in dirhams of full weight; and so gets back more than he lent. That is halal for him and permitted. Had a man bought defective dirhams from him as being the full weight; that would not be halal. MuwataMalik-017-001-3511886 Malik related to me from Mousa Ibn Maysara that he heard a man ask Said Ibn AlMusayab; I am a man who sells for a debt. Said said; Do not sell except for what you take to your camel. Malik spoke about a person who bought goods from a man provided that he provide him with those goods by a specific date; either in time for a market in which he hoped for their saleability; or to fulfil a need at the time he stipulated. Then the seller failed him about the date; and the buyer wanted to return those goods to the seller. Malik said; The buyer cannot do that; and the sale is binding on him. If the seller does bring the goods before the completion of the term; the buyer cannot be forced to take them. Malik spoke about a person who bought food and measured it. Then some one came to him to buy it and he told him that he had measured it for himself and taken it in full. The new buyer wanted to trust him and accept his measure. Malik said; Whatever is sold in this way for cash has no harm in it but whatever is sold in this way on delayed terms is disapproved of until the new buyer measures it out for himself. The sale with delayed terms is disapproved of because it leads to usury and it is feared that it will be circulated in this way without weight or measure. If the terms are delayed it is disapproved of and there is no disagreement about that with us. Malik said; One should not buy a debt owed by a man whether present or absent; without the confirmation of the one who owes the debt; nor should one buy a debt owed to a man by a dead person even if one knows what the deceased man has left. That is because to buy that is an uncertain transaction and one does not know whether the transaction will be completed or not completed. He said; The explanation of what is disapproved of in buying a debt owed by someone absent or dead; is that it is not known what unknown debtor may be connected to the dead person. If the dead person is liable for another debt; the price which the buyer gave on strength of the debt may become worthless. Malik said; There is another fault in that as well. He is buying something which is not guaranteed for him; and so if the deal is not completed; what he paid becomes worthless. This is an uncertain transaction and it is not good. Malik said; One distinguishes between a man who is only selling what he actually has and a man who is being paid in advance for something which is not yet in his possession. The man advancing the money brings his gold which he intends to buy with. The seller says; This is 10 dinars. What do you want me to buy for you with it? It is as if he sold 10 dinars cash for 15 dinars to be paid later. Because of this; it is disapproved of. MuwataMalik-017-001-35333Yahya related to me from Malik from Ibn Shihab from Said Ibn AlMusayab and from Sulayman Ibn Yasar that Tulayha AlAsadiya was the wife of Rushayd AlThaqafi. He divorced her; and she got married in her idda-period. Umar Ibn AlKhattab beat her and her husband with a stick several times; and separated them. Then Umar Ibn AlKhattab said; If a woman marries in her idda-period; and the new husband has not consummated the marriage; then separate them; and when she has completed the idda of her first husband; the other becomes a suitor. If he has consummated the marriage then separate them. Then she must complete her idda from her first husband; and then the idda from the other one; and they are never to be reunited. Malik added; Said Ibn AlMusayab said that she had her dowry because he had consummated the marriage. MuwataMalik-017-001-35395Yahya related to me from Malik that Humayd Ibn Qays and Thawr Ibn Zayd adDili both informed him that the Messenger of Allah; may Allah bless him and grant him peace; and one of them gave more detail than the other ;saw a man standing in the sun. The Messenger asked; What wrong with him? The people said; He has vowed not to speak or to seek shade from the sun or to sit and to fast. The Messenger of Allah; may Allah bless him and grant him peace; said; Go and tell him to speak; seek shade; and sit; but let him complete his fast. Malik said; I have not heard that the Messenger of Allah; may Allah bless him and grant him peace; ordered the man in question to do any kaffara. MuwataMalik-017-001-35533Yahya related to me from Malik that Humayd Ibn Oays AlMakki told him; I was with Mujahid while he was performing tawaf around the Kaba; and a man came to him and asked whether the days of fasting for kaffara had to be fasted consecutively; or could they be split up. I said to him; Yes; they can be split up; if the person so wishes. Mujahid said; He should not split them up; because in Ubay Ibn Kaab recitation they are referred to as three consecutive days. Malik said; What I like most is what Allah has specified in the Quran; that is; that they are fasted consecutively. Malik was asked about a woman who began the day fasting in Ramadan and though it was outside of the time of her period; fresh blood i.e. not menstrual blood flowed from her. She then waited until evening to see the same; but did not see anything.Then; on the next day in the morning she had anotherflow; though less than the first. Then; some days before her period; the flow stopped completely. Malik was asked what she should do about her fasting and prayer; and he said; This blood is like menstrual blood. When she sees it she should break her fast; and then make up the days she has missed. Then; when the blood has completely stopped; she should do ghusl and fast. Malik was asked whether someone who became muslim on the last day of Ramadan had to make up all of Ramadan or whether he just had to make up the day when he became muslim; and he said; He does not have to make up any of the days that have passed. He begins fasting from that day onwards. MuwataMalik-017-001-35535Yahya said that he heard Malik say; Someone who eats or drinks out of neglect or forgetfulness during a voluntary fast does not have to repeat his fast; but he should continue fasting for the rest of the day in which he eats or drinks while voluntarily fasting; and not stop fasting. Someone to whom something unexpected happens which causes him to break his fast while he is fasting voluntarily does not have to repeat his fast if he has broken it for a reason; and not simply because he decided to break his fast. Just as I do not think that someone has to repeat a voluntary prayer if he has had to stop it because of some discharge which he could prevent and which meant that he had to repeat his Ablution. Malik said; Once a man has begun doing any of the right actions Alamal AlSaliha such as the prayer; the fast and the hajj; or similar right actions of a voluntary nature; he should not stop until he has completed it according to what the sunna for that action is. If he says the takbir he should not stop until he has prayed two rakas. If he is fasting he should not break his fast until he has completed that day fast. If he goes into ihram he should not return until he has completed his hajj; and if he begins doing tawaf he should not stop doing so until he has gone around the Kaba seven times. He should not stop doing any of these actions once he has started them until he has completed them; except if something happens such as illness or some other matter by which a man is excused. This is because Allah; the Blessed and Exalted; says in His Book; And eat and drink until the white thread becomes clear to you from the black thread of dawn; and then complete the fast until night-time; Surat 2 ayat 187 ; and so he must complete his fast as Allah has said. Allah; the Exalted; also says; And complete the hajj and the umra for Allah; and so if a man were to go into ihram for a voluntary hajj having done his one obligatory hajj on a previous occasion ; he could not then stop doing his hajj having once begun it and leave ihram while in the middle of his hajj. Anyone that begins a voluntary act must complete it once he has begun doing it; just as an obligatory act must be completed. After every seven tawafs he would pray two rakas; sometimes at the maqam of Ibrahim; and sometimes elsewhere. Malik was asked whether a man doing voluntary tawaf could; to make it easier on himself; join two or more sets of seven circuits and then pray whatever he owed for those sets of seven; and he said; He should not do that. The sunna is that he does two rakasafter every seven circuits. Malik said; about someone who began doing tawaf and then forgot how many he had done and did eightor nine circuits; He should stop when he knows that he has done more than the right number and then pray two rakas;and he should not count the ones that he has done in excess. Neither should he build on the nine that he has done and then pray the rakas for the two sets of seven circuits together; because the sunna is that you pray two rakas after every seven circuits. Malik said that someone who was in doubt about his tawaf after he had prayed the two rakas of tawaf should go back and complete his tawaf until he was certain of how much he had done. He should then repeat the two rakas; because prayer when doing tawaf was only valid after completing seven circuits. If some one breaks his Ablution either while he is doing tawaf; or when he has finished tawaf but before he has prayed the two rakas of tawaf; he should do Ablution and begin the tawaf and the two rakas afresh. MuwataMalik-017-001-35865Yahya related to me from Malik from Hisham Ibn Urwa that Sawda bint Abdullah Ibn Umar; who was in the household of Urwa Ibn AlZubayr; set off walking between Safa and Marwa when doing either hajj or an umra. She was a heavy woman and she began when everybody was leaving after the isha prayer; and she still had not completed her circuits when the first call was given for subh; but finished them between the two calls to prayer. If Urwa saw people doing circuits on riding beasts he would tell them in very strong terms not to do so; and they would pretend to be ill; out of awe of him. Hisham added; He used to say to us about them These are unsuccessful and have lost. Malik said; Someone who forgets say between Safa and Marwa in an umra; and does not remember until he is far from Makka; should return and do say. If; in the meantime; he has had intercourse with a woman; he should return and do say between Safa and Marwa so as to complete what remains of that umra; and then after that he has to do another umra and offer a sacrificial animal. Malik was asked about someone who met another man when doing say between Safa and Marwa and stopped to talk with him; and he said; I do not like anyone to do that. Malik said; If anyone forgets some of his tawaf or is uncertain about it and remembers only when he is doing say between Safa and Marwa; he should stop the say and complete his tawaf of the House apart from that about which he is certain. Pure actions belong to Allah. Peace be on the Prophet and the mercy of Allah and His blessings. Peace be on us and on the slaves of Allah who are salihun. I testify that there is no god except Allah. I testify that Muhammad is the Messenger of Allah. Bismillah; AlTahiyatu lillah; AlSalawatu lillah; AlZakiyatu lillah. AlSalamu alan-nabiyi wa rahmatullahi wa barakatuhu. AlSalamu alayna wa ala ibadillahis-salihin. Shahidtu an la ilaha illallah. Shahidtu anna Muhammad AlRasulullah. He used to say this after the first two rakas and he would make supplication with whatever seemed fit to him when the tashahhud was completed. When he sat at the end of the prayer; he did the tashahhud in a similar manner; except that after the tashahhud he made supplication with whatever seemed fit to him. When he had completed the tashahhud and intended to say the taslim; he said; Peace be on the Prophet and His mercy and blessings. Peace be upon us and on the slaves of Allah who are salihun. Alsalamu alan-nabiyi wa rahmatullahi wa barakatuhu. AlSalamu alayna wa ala ibadillahissalihin.
