But neither of these taught anyone (Such things) without saying: "We are only for trial; so do not blaspheme." They learned from them the means to sow discord between man and wife. But they could not thus harm anyone except by Allah's permission. And they learned what harmed them, not what profited them. And they knew that the buyers of (magic) would have no share in the happiness of the Hereafter. And vile was the price for which they did sell their souls, if they but knew!

Thou didst say to one who had received the grace of Allah and thy favour: "Retain thou (in wedlock) thy wife, and fear Allah." But thou didst hide in thy heart that which Allah was about to make manifest: thou didst fear the people, but it is more fitting that thou shouldst fear Allah. Then when Zaid had dissolved (his marriage) with her, with the necessary (formality), We joined her in marriage to thee: in order that (in future) there may be no difficulty to the Believers in (the matter of) marriage with the wives of their adopted sons, when the latter have dissolved with the necessary (formality) (their marriage) with them. And Allah's command must be fulfilled.

But if ye do good and practise self-restraint, Allah is well-acquainted with all that ye do.

Zainab used to boast before the wives of the Prophet ﷺ and used to say; You were given in marriage by your families; while I was married to the Prophet by Allah from over seven Heavens. SahihAlBukhari-017-001-1208Narrated Abu Huraira: While we were with Allah Messenger ﷺ a bedouin got up and said; O Allah Messenger ﷺ ! Settle my case according to Allah Book Laws. Then his opponent got up and said; O Allah Messenger ﷺ ! He has said the truth! Settle his case according to Allah Book Laws. and allow me to speak; He said; My son was a laborer for this man and he committed illegal sexual intercourse with his wife. The people told me that my son should be stoned to death but I ransomed him with one-hundred sheep and a slave girl. Then I asked the religious learned people and they told me that his wife should be stoned to death and my son should receive one-hundred lashes and be sentenced to one year of exile. The Prophet ﷺ said; By Him in Whose Hands my life is; I will judge between you according to Allah Book Laws : As for the slave girl and the sheep; they are to be returned; and as for your son; he shall receive onehundred lashes and will be exiled for one year. You; O Unais! addressing a man from Bani Aslam; Go tomorrow morning to the wife of this man and if she confesses; then stone her to death. SahihAlBukhari-017-001-1437Narrated Sahl Bin Saad AlSaidi: Uwaimir AlAjlani came to Aasi m Bin Adi and said; If a man found another man with his wife and killed him; would you sentence the husband to death in Qisas; i.e.; equality in punishment ? O Aasi m! Please ask Allah Messenger ﷺ about this matter on my behalf. Aasi m asked the Prophet ﷺ but the Prophet disliked the question and disapproved of it. Aasi m returned and informed Uwaimir that the Prophet disliked that type of question. Uwaimir said; By Allah; I will go personally to the Prophet. Uwaimir came to the Prophet ﷺ when Allah had already revealed Quranic Verses in that respect ; after Aasi m had left the Prophet ﷺ. So the Prophet ﷺ said to Uwaimir; Allah has revealed Quranic Verses regarding you and your wife. The Prophet ﷺ then called for them; and they came and carried out the order of Lian. Then Uwaimir said; O Allah Messenger ﷺ ! Now if I kept her with me; I would be accused of telling a lie. So Uwaimir divorced her although the Prophet ﷺ did not order him to do so. Later on this practice of divorcing became the tradition of couples involved in a case of Lian. The Prophet ﷺ said to the people. Wait for her! If she delivers a red short small child like a Wahra a short red animal. then I will be of the opinion that he Uwaimir has told a lie but if she delivered a black big-eyed one with big buttocks; then I will be of the opinion that he has told the truth about her. Ultimately she gave birth to a child that proved the accusation. Then the man opponent who was wiser than him; got up saying to Allah Messenger ﷺ Judge us according to Allah Law and kindly allow me to speak. The Prophet ﷺ said; Speak. He said; My son was a laborer working for this man and he committed an illegal sexual intercourse with his wife; and I gave one-hundred sheep and a slave as a ransom for my son sin. Then I asked a learned man about this case and he informed me that my son should receive one hundred lashes and be exiled for one year; and the man wife should be stoned to death. The Prophet ﷺ said; By Him in Whose Hand my soul is; I will judge you according to the Laws of Allah. Your one-hundred sheep and the slave are to be returned to you; and your son has to receive one-hundred lashes and be exiled for one year. O Unais! Go to the wife of this man; and if she confesses; then stone her to death. Unais went to her and she confessed. The sheep and the slave girl will be returned to you and your son will be flogged one-hundred stripes and be exiled for one year. And you; O Unais! Go to the wife of this man and if she confesses ; stone her to death. SahihAlBukhari-017-001-1614Narrated Ibn Abbas: Lian was mentioned in the presence of the Prophet; Aasi m Bin Adi said a statement about it; and when he left; a man from his tribe came to him complaining that he had seen a man with his wife. Aasi m said; I have been put to trial only because of my statement. So he took the man to the Prophet ﷺ and the man told him about the incident. The man husband was of yellow complexion; thin; and of lank hair; while the man whom he had accused of having been with his wife; was reddish brown with fat thick legs and fat body. The Prophet ﷺ said; O Allah! Reveal the truth. Later on the lady delivered a child resembling the man whom the husband had accused of having been with her. So the Prophet ﷺ made them take the oath of Lian. A man said to Ibn Abbas in the gathering; Was that the same lady about whom the Prophet ﷺ said; If I were to stone any lady for committing illegal sexual intercourse to death without witnesses; I would have stoned that lade to death? SahihAlBukhari-017-001-2657Narrated Abdulrahman Bin Abu Bakr: Abu Bakr came with a guest or some guests; but he stayed late at night with the Prophet ﷺ and when he came; my mother said to him ; Have you been detained from your guest or guests tonight? He said; Havent you served the supper to them? She replied; We presented the meal to him or to them ; but he or they refused to eat. Abu Bakr became angry; rebuked me and invoked Allah to cause my ears to be cut and swore not to eat of it! I hid myself; and he called me; O ignorant boy ! Abu Bakr wife swore that she would not eat of it and so the guests or the guest swore that they would not eat of it till he ate of it. Abu Bakr said; All that happened was from Satan. So he asked for the meals and ate of it; and so did they. Whenever they took a handful of the meal; the meal grew increased from underneath more than that mouthful. He said to his wife ; O; sister of Bani Firas! What is this? She said; O; pleasure of my eyes! The meal is now more than it had been before we started eating So they ate of it and sent the rest of that meal to the Prophet. SahihMuslim-017-001-19916Anas Bin Malik reported that the son of Abu Talha had been ailing. Abu Talha set out on a journey and his son breathed his last in his absence. When Abu Talha came back; he said to his wife : What about my child? Umm Sulaim the wife of Abu Talha said: He is now in a more comfortable state than before. She served him the evening meal and he took it. He then came to her and had sexual intercourse with her and when it was all over she said: Make arrangements for the burial of the child. When it was morning. Abu Talha came to Allah Messenger ﷺ and informed him; whereupon he said: Did you spend the night with her. He said: Yes. He the Holy Prophet then said: O Allah; bless both of them and as a result of blessing she gave birth to a child. Abu Talha said to me Anas Bin Malik to take the child; so I took him and came to Allah Messenger ﷺ. She Umm Sulaim also had sent some dates along with the child. Allah Apostle ﷺ took him the child in his lap and said: Is there anything with you for Tahnik. They the Companions said: Yes. Allah Apostle ﷺ took hold of them dates and chewed them. SahihMuslim-017-001-20151Abu Huraira reported Allah Messenger ﷺ as saying: Prophet Ibrahim ﷺ never told a lie but only thrice: two times for the sake of Allah for example; his words : I am sick; and his words: But it was the big one amongst them which has done that and because of Sara his wife. He had come in a land inhabited by haughty and cruel men along with Sara. She was very good-looking amongst the people; so he said to her: If these people were to know that you are my wife they would snatch you away from me; so if they ask you tell them that you are my sister and in fact you are my sister in Islam; and I do not know of any other Muslim in this land besides I and you. And when they entered that land the tyrants came to see her and said to him the king : There comes to your land a woman; whom you alone deserve to possess; so he the king sent someone towards her and she was brought to him; and Ibrahim ﷺ stood in prayer. When she visited him the tyrant king came he could help but stretch his hand towards her and his hand was tied up. He said: Supplicate to Allah so that He may release my hand and I will do no harm to you. She did that and the man repeated the same highhandedness and his hand was again tied up more tightly than on the first occasion. He said the same thing to her again; and she again did that supplicated ; but he repeated the same highhandedness and his hands were tied up more tightly than on the previous occasion. He then again said: Supplicate your Lord so that He may set my hand free; by Allah I shall do no harm to you. She did and his hand was freed. Then he called the person who had brought her and said to him: You have brought to me the satan and you have not brought to me a human being; so turn them out from my land; and he gave Hajar as a gift to her. She returned along with Hajar and when Ibrahim ﷺ saw her; he said: How have you returned? She said: With full safety have I returned. Allah held the hand of that debauch and he gave me a maid-servant. Thereupon Abdullah said: Should I not curse one upon whom Allah Messenger ﷺ has invoked curse and that is in the Book also. Thereupon that woman said: I read the Quran from cover to cover; but I did not find that in it. whereupon he said: If you had read thoroughly you would have definitely found this in that as Allah; the Exalted and Glorious; has said: What Allah Messenger brings for you accept that and what he has forbidden you; refrain from that. That woman said: I find this thing in your wife even now. Thereupon he said: Go and see her. She reported: I went to the wife of Abdullah but found nothing of this sort in her. Aisha further reported: The wives of Allah Apostle ﷺ then sent Zainab Bin Jahsh; the wife of Allah Apostle ﷺ ; and she was one who was somewhat equal in rank with me in the eyes of Allah Messenger ﷺ and I have never seen a woman more advanced in religious piety than Zainab; more God-conscious; more truthful; more alive to the ties of blood; more generous and having more sense of self-sacrifice in practical life and having more charitable disposition and thus more close to God; the Exalted; than her. She; however; lost temper very soon but was soon calm. Allah Messenger ﷺ permitted her to enter as she Aisha was along with Allah Messenger ﷺ in her mantle; in the same very state when Fatima had entered. She said: Allah Messenger; your wives have sent me to you seeking equity in case of the daughter of Abu Quhafa. She then came to me and showed harshness to me and I was seeing the eyes of Allah Messenger ﷺ whether he would permit me. Zainab went on until I came to know that Allah Messenger ﷺ would not disapprove if I retorted. Then I exchanged hot words until I made her quiet. SahihMuslim-017-001-21095Jabir Bin Abdullah reported: When the ditch was dug; I saw Allah Messenger may peace he upon him feeling very hungry. I came to my wife and said to her: Is there anything with you? I have seen Allah Messenger ﷺ feeling extremely hungry. She brought out a bag of provisions which contained a sa; of barley. We had also with us a lamb. I slaughtered it. She ground the flour. She finished this work along with me. She said: Do not humiliate me in the presence of Allah Messenger ﷺ and those who are with him. When I came to him I whispered to him saying: Allah Messenger; we have slaughtered a lamb for you and she has ground a sa of barley which we had with us. So you come along with a group of people with you. Thereupon Allah Messenger ﷺ said loudly: O people of the ditch; Jabir has arranged a feast for you; so come along. Allah Messenger ﷺ said: Do not remove your earthen pot from the hearth and do not bake the bread from the kneaded flour until I come. So I came and Allah Messenger ﷺ came and he was ahead of the people; and I came to my wife and she said to me : You will be humbled. I said: I did what you had asked me to do. She his wife said: I brought out the kneaded flour and Allah Messenger ﷺ put some saliva of his in that and blessed It. He then put saliva in the earthen pot and blessed it and then said. Call another baker who can bake with you. and bring out the soup from it; but do not remove it from the hearth; and the guests were one thousand. SahihMuslim-017-001-21145Abd AlRabman Bin Abu Bakr reported that the people of Suffa were very poor. Once the Messenger of Allah ﷺ said to his Companions : He who amongst you has food for two persons should take three guests with him. and he who has with him food for four persons should take five or six guests with him for entertaining them. It was in accordance with these instructions of the Holy Prophet that Abu Bakr brought three persons; and the Messenger of Allah ﷺ brought ten persons as guests to their respective houses. Abu Bakr had brought three persons he himself; and myself ; my father and my mother along with therm. He the narrator said: I do not know whether he also said: My wife and one servant who was common between our house and that of Abu Bakr. Abu Bakr had had his evening meal with Allah Apostle ﷺ. He stayed here until night prayer had been offered. He then came back to the house of Allah Apostle and stayed there until Allah Messenger ﷺ felt drowsy and Abu Bakr then came back to his own house when a considerable part of the night had been over; as Allah had desired. His wife said to him: What held you back from your guests? He said: Oh! have you not served them the evening meal by this time ? She said: It was in fact served to them. but they refused to eat until you came. He Abdulrahman said: I slunk away and bid myself. He Abu Bakr said: O; you stupid fellow; and he reprimanded me; and said to the guests: Eat; though it may not be pleasant now. He said: By Allah. I will never eat it He Abdulrahman said: By Allah. we did not take a morsel when from beneath that there appeared more until they had eaten to their fill; and lo! it was more than what it was before. Abu Bakr saw that and found that it was so or more than that. He said to his wife: Sister of Band Firis; what is th-is? She said: By the coolness of my eyes. it is in excess by three times over the previous one. Then Abu Bakr ate saying: That was from the Satan viz. his vow for not eating the food. He then took a morsel out of that and then took it the rest to the Messenger of Allah ﷺ ; and it was kept there until morning; and during those days there was a covenant between us and some other people; and the period of covenant was over; and we had appointed twelve officials with every person amongst them. It is Allah only Who knows as to how many people were there with each of them. Uwaimir proceeded until he came to Allah Messenger ﷺ as he was sitting amidst people; and said: Messenger of Allah; tell me about a person who found a man with his wife. Should he kill him; and then you would kill him; or how should he act? Thereupon Allah Messenger ﷺ said: Verses have been revealed concerning you and your wife; so go and bring her. Sahl said that they both invoked curses and further said : I was along with people in the company of Allah Messenger ﷺ. And when they had finished; Uwaimir said: Allah Messenger; I shall have told a lie against her if I keep her now. So he divorced her with three pronouncements before Allah Messenger ﷺ had commanded him. SahihMuslim-017-001-21198Saeed b Jubair reported: I was asked about the invokers of curses during the reign of mousab Bin AlZubair whether they could separate themselves by this process. He said: I did not understand what to say. So I went to the house of Ibn Umar Allah be pleased with them in Mecca. I said to his servant: Seek permission for Me. He said that he Ibn Umar had been taking rest. He Ibn Umar heard my voice. and said: Are you Ibn Jubair? I said: Yes. Hesaid: Come in. By Allah; it must be some great need which has brought you here at this Hour. So I got in and found him lying on a blanket reclining against a pillow stuffed with fibres of date-palm. I said: O AbuAbd AlRahman; should there be separation between the invokers of curses? He said: Hallowed be Allah; yes; The first one who asked about it was so and so. he said: Messenger of Allah; tell me If one of us finds his wife committing adultery: what should he do? If he talks; that is something great; and if he keeps quiet that is also something great which he cannot afford to do. Allah Prophet ﷺ kept quiet or some time. After some time he that very person came to him Allah Messenger and said: I have been involved in that very cage about which I had asked you Allah the Exalted and Majestic then revealed these verses of Surah Nur: Those who accuse their wives verse 6 ; and he the Holy Prophet recited them to him and admonished him; and exhorted him and informed him that the torment of the world is less painful than the torment of the Hereafter. He said: No; by Him Who sent you with Truth; I did not tell a lie against her. He the Holy Prophet then called her the wife of that person who had accused her and admonished her; and exhorted her; and informed her that the torment of this world is less painful than the torment of the Hereafter. She said: No; by Him Who sent thee with Truth; he is a liar. it was the man who started the swearing of oath and he swore in the name of Allah four times that he was among the truthful. and at the fifth turn he said: Let there be curse of Allah upon him if he were among the liars. Then the woman was called and she swore four times in the name of Allah that he her husband was among the liars; and at the fifth time she said : Let there be curse upon her if he were among the truthful. SahihMuslim-017-001-21207Abdullah reported: We were on the night of Friday staying in the Masjid when a person from the Ansar came there and said: If a person finds hiswoman along with a man; and he speaks about it; you would lash him; and if he kills; you will kill him; and if he keeps quiet he shall have to consume anger. By Allah; I will definitely ask about him from Allah Mescenger ﷺ. On the following day he came to Allah Messenger ﷺ and asked him thus: If a man were to find with his wife a man and if he were to talk about it; you would lash him; and if he killed; you would kill him; and if he were to keep quiet. he would consume anger; whereupon he the Holy Prophet said: Allah; solve this problem ; and he began to supplicate before Him ; and then the verses pertaining to lian were revealed: Those who accuse their wives and have no witnesses except themselves xxiv. 6. The person was then put to test according to these verses in the presence of the people. There came he and his wife in the presence of Allah Messenger ﷺ ; and they invoked curses in order to testify their claim. The man swore four times in the name of Allah that he was one of the truthful and then invoked curse for the fifth time saying: Let there be curse of Allah upon him if he were among the liars. Then she began to invoke curse. SahihMuslim-017-001-21210Ibn Abbas Allah be pleased with them reported: Mention was made of lian in the presence of Allah Messenger ﷺ. And Aasi m Bin Adi passed a remark about it and then turned away; and a man of his tribe came to him complaining that he had found a man with his wife; whereupon Aasi m said: I have been taken by my words. He took him to Allah Messenger ﷺ and told him about the man whom he had found with his wife and this man was a lean; yellow-coloured man with lank hair; and the person who was accused of committing adultery with her his wife had fleshy shanks; with wheat complexion and heavy bulk. Allah Messenger ﷺ said: O Allah; make this case manifest. And as she gave birth to a child; whose face resembled that person about whom her husband had made mention that he had found her with; and Allah Messenger may peace be; upon him had asked them to invoke curses. A person said to Ibn Abbas Allah be pleased with him : Is she that woman about whom Allah Messenger may peace be upen him said : If I were to stone anybody without evidence; I would have stoned her? SahihMuslim-017-001-21478Abdullah Bin Umar reported that he divorced a wife of his with the pronouncement of one divorce during the period of menstruation. Allah Messenger ﷺ commanded him to take her back and keep her until she was purified; and then she entered the period of menses in his house for the second time. And he should wait until she was purified of her menses. And then if he would decide to divorce her; he should do so when she was purified before having a sexual intercourse with her; for that was the Idda which Allah had commanded for the divorce of women. Ibn Rumh in his narration made this addition: When Abdullah was asked about it; he said to one of them: If you have divorced your wife with one pronouncement or two then you can take her back ; for Allah Messenger ﷺ commanded me to do it; but if you have divorced her with three pronouncements; then she is forbidden for you until she married another husband; and you disobeyed Allah in regard to the divorce of your wife what He had commanded you. He said: So my mother; Umm Sulaim prepared some Hais in a Tawr a vessel made of brass and stone and said: O Anas! Take this to the Prophet ﷺ. I said to him: My mother sent this to you; and she conveys her Salam; and says: This is a little something from us for you. He said: Put it down. Then he said: Go and invite so-and-so; so-and-so; and so-and-so for me; and whomever you meet. He named some people; and said: I invited those he named; and whomever I met. - He AlJad said: I said to Anas: How many of you were there? He said: Roughly about three-hundred. - He Anas said: The Messenger of Allah ﷺ said to me: O Anas! Bring me the Tawr. He said: They entered until the Suffah a shaded part of the Masjid in AlMadinah and the apartment were full. The Messenger of Allah ﷺ said: Let groups of ten in; and let each person eat what is near him. He said: They ate until they were full. He said: A group exited; and another group entered; until all of them ate. He said: He said to me: O Anas! Remove it. He said: So I took it. I could not tell if there was more when I first put it down; or when I picked it up. He said: Groups of them sat talking in the house of the Messenger of Allah ﷺ ; while the Messenger of Allah ﷺ and his wife sat facing the wall. They began to be burdensome on the Messenger of Allah ﷺ ; so the Messenger of Allah ﷺ went out to greet his women folk; then he returned; they realized that they had overburdened him; so they hastened for the gate and all of them exited. The Messenger of Allah ﷺ came until he lowered the curtain; and entered while I was sitting in the apartment. He did not remain there long before he left me; and these Ayat were revealed. So the Messenger of Allah ﷺ went out to recite them to the people: O you who believe! Do not enter the Prophet house unless permission is given to you for a meal; not to wait for its preparation. But when you are invited; enter; and when you have taken your meals; dispense without sitting for a talk. SunanAlTermithi-017-001-7653Narrated Ubaidullah Bin Abdullah Bin Uthbah: That he heard from Abu Huraira; Zaid Bin Khalid; and Shibl; that they were with the Prophet ﷺ and two men came to him disputing. So one of them stood before him and said: I ask you by Allah; O Messenger of Allah! Only that you would judge between us by the book of Allah. So his disputant said - and he was more eloquent that him: I agree of O Messenger of Allah! Judge between us by the Book of Allah; and allow me to speak. My son was a servant for this man and he committed adultery with his wife. So they told me that my son was to be stoned. I paid him one hundred female sheep and a female slave. Then I met some people from the people of knowledge and they said that my son was to be lashed one hundred times; and to be banished for a year and that stoning is only for this man wife. So the Prophet ﷺ said: By the One in Whose Hand is my soul! I will judge between you two by the Book of Allah. The one hundred female sheep and the female slave should be returned to you. For your son is one hundred lashes and banishment for a year. O Unais! Go to this Man wife; and if she confesses then stone her. So they ate and they drank from that water. The Messenger of Allah s.a.w said: By the One in Whose Hand is my soul! This is among the favors which you shall be asked about on the Day Of Judgment. Cool shade; tasty ripe dates; and cool water. Abu AlHaitham left to prepare some food for them. The Prophet ﷺ said: Do not slaughter one with milk. So he Slaughtered a small female or male goat and brought it to them so they could eat it. The Prophet ﷺ said: Do you have any servants? He said: No. So he said: Then if we get some captives we shall bring them for you. So later the Prophet ﷺ came with 2 males; there was no third among them and he brought them to Abu AlHaitham. The Prophet ﷺ said: Choose from them. He said: O Prophet of Allah! Choose for me. So the Prophet ﷺ said: Indeed the one consulted is entrusted. Take this one for I have seen him praying; and encourage him to do well. So Abu AlHaitham went to his wife and informed her of what the Messenger of Allah s.a.w said. So his wife said: You will not fulfill what the Prophet ﷺ said until you have freed him. So he said: He is free. So the Prophet ﷺ said: Indeed Allah has not send a Prophet nor made a Khalifah except that he has two groups of supporters; group ordering him to do good; and prohibiting him from evil and a group that never ceases spoiling his affairs. Qais Bin Sirmah AlAnsari fasted and came to his wife at the time of Iftar; and said to her: No; but I will go and bring something for you. He worked during the day; so his eyes sleep overcame him. One of them said: O Messenger of Allah; pass judgment between us according to the Book of Allah. The other; who was wiser; said: Yes; O Messenger of Allah; and allow me to speak. He said: My son was a laborer serving this man; and he committed Zina with his wife. They told me that my son was to be stoned to death; but I ransomed him with one hundred sheep and a slave girl of mine. Then I asked the people of knowledge; who told me that my son was to be given one hundred lashes and exiled for a year; and that his the mans wife was to be stoned to death. The Messenger of Allah SAWSYMOBOL said: By the One in Whose hand is my soul; I will pass judgment between you according to the Book of Allah. As for your sheep and your slave girl; take them back. Hind bint AlWalid Bin Utbah was one of the first Muhajir women; and at that time she was one of the best single women of the Quraish. SunanAlNasai-017-001-14699It was narrated from Sulaiman Bin Buraidah; from his father; that the Messenger of Allah ﷺ said: The sanctity of the wive of the Mujahidin to those who stay behind is like the sanctity of their mothers. If he takes on the responsibility of looking after his wife then betrays him; it will be said to him on the Day of Resurrection: This one betrayed you with your wife; so take whatever you want of his good deeds. AlAsadi said: I said: Our milch-camel is worth more than an Uqiyah; and an Uqiyah is forty Dirhams. So I went back and did not ask him for anything. If a man finds another man with his wife; should he kill him; and be killed in retaliation; or what should he do? O Aasi m! Ask the Messenger of Allah about that for me. So Aasi m asked the Messenger of Allah about that; and the Messenger of Allah disapproved of the question; and criticized the asking of too many questions until Aasi m felt upset. When Aasi m went back to his people; Uwaimir came to him and said: O Aasi m; what did the Messenger of Allah say to you? Aasi m said: You have not brought me any good. The Messenger of Allah disapproved of the question you asked. Uwaimir said: By Allah; I will go and ask the Messenger of Allah. So he went to the Messenger of Allah and found him in the midst of the people. He said: O Messenger of Allah; what do you think if a man finds another man with his wife -should he kill him; and be killed in retaliation or what should he do? The Messenger of Allah said: Something has been revealed concerning you and your wife; so go and bring her here. I lay towards the width of the pillow and the Messenger of Allah ﷺ and his wife slept towards its length. The Messenger of Allah ﷺ slept. When half the night passed; or a little before it or a little after it; the Messenger of Allah ﷺ awoke and began to rub his face eyes to remove the sleep. He then recited ten verses from the last part of Surah AlImran. Hen then came to a bag of water that was hanging. He performed ablution from it and performed his ablution well. He then stood up and prayed. I also got up and did as he did. I then went and stood at his side. The Messenger of Allah ﷺ placed his right hand upon my head and took me by my ear twisting it. He then prayed two rakahs; then two rakahs; then two rakahs; then two rakahs; then two rakahs; then two rakahs. The narrator AlQanabi said: Six times. He observed the witr prayer; and then slept until the muadhdhin came. He said: Abdullah Ibn Umar divorced his wife while she was menstruating during the time of the Messenger of Allah ﷺ.So Umar asked the Messenger of Allah ﷺ saying: Abdullah Ibn Umar divorced his wife while she was menstruating. Abdullah said: He returned her to me and did not count it the pronouncement anything. He said: When she is purified; he may divorce her or keep her with him. Ibn Umar said: The Prophet ﷺ recited the Quranic verse: O Prophet; when you divorce women; divorce them in the beginning of their waiting period.Abu Dawud said: This tradition has been narrated by Yunus Bin Jubair; Anas Bin Seereen Bin Jubair; Zaid Bin Aslam; Abu AlZubair and Mansur from Abu Wail on the authority of Ibn Umar. They all agreed on the theme that the Prophet ﷺ commanded him to take her back and keep her till she was purified. Then if he desired; he might divorce her or keep her with him if he wanted to do so. The version narrated by AlZuhri from Salim from Nafi on the authority of Ibn Umar has: The Prophet ﷺ commanded him to take her back and keep her till she is purified; and then has menstrual discharge; and then she is purified. Then if he desires; he may divorce her and if he desires he may keep her.Abu Dawud said: A version like that of Nafi and AlZuhri has also been transmitted by Ata AlKhurasani from AlHasan on the authority of Ibn Umar. She went to the Prophet ﷺ and said: He is of no use to me except that he is as useful to me as a hair; and she took a hair from her head. So separate me from him. The Prophet ﷺ became furious. He called on Rukanah and his brothers. He then said to those who were sitting beside him. Do you see so-and-so who resembles Abdu Yazid in respect of so-and-so; and so-and-so who resembles him in respect of so-and-so? They replied: Yes. The Prophet ﷺ said to Abdu Yazid: Divorce her. Then he did so. He said: Take your wife; the mother of Rukanah and his brothers; back in marriage. He said: I have divorced her by three pronouncements; Messenger of Allah. He said: I know: take her back. He then recited the verse: O Prophet; when you divorce women; divorce them at their appointed periods.Abu Dawud said: The tradition narrated by Nafi Bin Ujair and Abdullah Bin Yazid Bin Rukanah from his father on the authority of his grandfather reads: Rukanah divorced his wife absolutely i.e. irrevocable divorce. The Prophet ﷺ restored her to him. This version is sounder than other versions ; for they i.e. these narrators are the children of his man; and the members of the family are more aware of his case. Alaah has said And for those who fear Allaah; He ever prepares a way out. Since you did not keep duty to Allaah I do not find a way out for you. You disobeyed your Lord and your wife was separated from you. Allaah has said O Prophet! When you divorce women divorce them in the beginning of their waiting period.Abu Dawud said This tradition has been transmitted by Humaid AlAraj and by others from Mujahid on the authority of Ibn Abbas. Shubjh narrated it from Amr Bin Murrah from Said Bin Jubair on the authority of Ibn Abbas. Ayoub and Ibn Jubair both narrated it from Ikrimah Bin Khalid from Said Bin Jubair on the authority of Ibn Abbas. Ibn Juraij narrated it from Abd AlHamid Bin Rafi from Ata from Ibn Abbas. AlAmash narrated it from Malik Bin AlHarith on the authority of Ibn Abbas. They all said about the divorce by three pronouncements. He allowed it and said Your wife has been separated from you similar to the tradition narrated by Ismail from Ayoub from Abd Allaah Bin Kathir.Abu Dawud said Hammad Bin Zaid narrated it from Ayoub from Ikrimah on the authority of Ibn Abbas. This version adds If he said You are divorced three times saying in one pronouncement; it constitutes a single divorce. Ismail Bin Ibrahim narrated it from Ayoub from Ikrimah. This is his Ikrimahs statement. He did not mention the name of Ibn Abbas. So I made my wife like my mother back to me till the end of Ramadan. But one night when she was waiting upon me; something of her was revealed. Suddenly I jumped upon her. When the morning came I went to my people and informed them about this matter. I said: Go along with me to the Messenger of Allah ﷺ. They said: No; by Allah. So I went to the Prophet ﷺ and informed him of the matter. He said: Have you really committed it; Salamah? I said: I committed it twice; Messenger of Allah. I am content with the Commandment of Allah; the Exalted; so take a decision about me according to what Allah has shown you. He said: Free a slave. I said: By Him Who sent you with truth; I do not possess a neck other than this: and I struck the surface of my neck. He said: Then fast two consecutive months. I said: Whatever I suffered is due to fasting. He said: Feed sixty poor people with a wasq of dates. I said: By Him Who sent you with truth; we passed the night hungry; there was no food in our house. He said: Then go to the collector of sadaqah of Banu Zurayq; he must give it to you. Then feed sixty poor people with a wasq of dates; and you and your family eat the remaining dates. Then I came back to my people; and said to them : I found with you poverty and bad opinion; and I found with the Prophet ﷺ prosperity and good opinion. He has commanded me to give alms to you. Should he kill him and then be killed by you; or how should he act? Ask the Apostle of Allaah ﷺ Aasi m; for me about it. Aasi m then asked the Apostle of Allaah ﷺ about it. The Apostle of Allaah ﷺ disliked the question and denounced it. What Aasi m heard from the Apostle of Allaah ﷺ fell heavy on him. When Aasi m returned to his family Uwaimr came to him and asked Aasi m What did the Apostle of Allaah ﷺ say to you? Aasi m replied You did not do good to me. The Apostle of Allaah ﷺ disliked the question that I asked him. Thereupon Uwaimir said I swear by Allaah; I shall not leave until I ask him about it. So; Uwaimir came to the Apostle of Allaah ﷺ while he was sitting in the midst of the people. He said Apostle of Allaah ﷺ tell me about a man who finds a man along with his wife. Should he kill him and then be killed by you; or how should he act? The Apostle of Allaah ﷺ said A revelation has been sent down about you and your wife so go away and bring her. Sahl said So we cursed one another while I was along with the people who were with the Apostle of Allaah ﷺ. Then when they finished; Umamir said I shall have lied against her; Apostle of Allaah ﷺ if I keep her. SunanAbuDawoud-017-001-25092Abdullah bin Masud said We were in the Masjid on the night of a Friday; suddenly a man from the Ansar entered the Masjid. And said If a man finds a man along with wife and declares about her adultery you will flog him. Or if he kills you; you will kill him or if keeps silence he will keep silence in anger. I swear by Allaah; I shall ask the Apostle of Allaah ﷺ about it. On the next day he came to the Apostle of Allaah ﷺ and said If a man finds a man along with wife and declares about her adultery you will flog him. Or if he kills you; you will kill him or if keeps silence he will keep silence in anger. He said O Allaah; disclose. He kept on praying until the verses regarding invoking curses lian came down As for those who accuse their wives but have no witnesses except themselves. So; the man was first involved in this trial among the people. He and his wife came to the Apostle of Allaah ﷺ. They invoked curses on each other. The man bore witness before Allaah four times that the thing he said was indeed true. He then invoked curse of Allaah on him for the fifth time if he was a liar. She then wanted to invoke curses of Allaah on him. The Prophet ﷺ said Do not do that. Bust she refused and did so i.e.; invoked curses. SunanAbuDawoud-017-001-25093Ibn Abbas said Hilal Bin Umayah accused his wife in the presence of Prophet ﷺ of having committed adultery with Sharik Bin Sahma. The Prophet ﷺ said Produce evidence or you must receive punishment on your back. He said Apostle of Allaah ﷺ when one of us sees a man having intercourse with his wife should he go and seek evidence? But the Prophet ﷺ merely said You must produce evidence or you must receive punishment on your back. Hilal then said By Him Who sent you with the Truth; I am speaking Truly. May Allaah send down something which will free my back from punishment. Then the following Quranic verses were revealed And those who make charges against their spouses but have no witnesses except themselves reciting till he reached one of those who speak the truth. The Prophet ﷺ then returned and sent for them and they came to him. Hilal Bin Umayah stood up and testified and the Prophet ﷺ was saying Allaah knows that one of you is lying. Will one of you repent? Then the woman got up and testified; but when she was about to do it a fifth time saying that Allaahs anger be upon her if he was one of those who spoke the truth; they said to her this is the deciding one. Ibn Abbas said She then hesitated and drew back so that we thought the she would withdraw what she said Look and see whether she gives birth to a child with eyes looking as if they have antimony in them; wide buttocks and fat legs; if she did. Sharik Bin Sahma will be its father. She then gave birth to a child of a similar description. The Prophet ﷺ thereupon said If it were not for what has already been stated in Allaahs book I would have dealt severely with her.Abu Dawud said This tradition has been transmitted by the people of Medina alone. SunanAbuDawoud-017-001-25111Aisha wife of the Prophet ﷺ said Marriage in pre Islamic times was of four kinds. One of them was the marriage contracted by the people today. A man asked another man to marry his relative sister or daughter to him. He fixed the dower and married her to him. Another kind of marriage was that a man asked his wife when she became pure from menstruation to send fro so and so and have sexual intercourse with him. Her husband kept himself aloof and did not have intercourse with her till It became apparent that she was pregnant from the man who had intercourse with her. When it was manifest that she was pregnant; her husband approached her if he liked. This marriage was called istibda to utilize man for intercourse for a noble birth. A third kind of marriage was that a group of people less than ten in number entered upon a woman and had intercourse with her. When she conceived gave birth to a child and a number of days passed after her delivery; she sent for them. No one of them could refuse to attend and they gathered before her. She said to them You have realized your affair. I have now given birth to a child. And this is your son. O so and so. She called the name of anyone of them she liked and the child was attributed to him. A fourth kind of marriage was that many people gathered together and entered upon a woman who did not prevent anyone who came to her. They were prostitutes. They hoisted flags at their doors which served as a sign for the one who intended to enter upon them. When she became pregnant and delivered the child ; they got together before her and called for the experts of tracing relationship from physical features. They attributed the child to whom they considered and it was given to him. The child was called his son and he could not deny. SunanAbuDawoud-017-001-26298Narrated Laqit Ibn Sabirah: I was the leader of the delegation of Banu AlMuntafiq or the narrator doubted I was among the delegation of Banu AlMuntafiq that came to the Messenger of Allah ﷺ. When we reached the Prophet; we did not find him in his house. We found there Aisha; the Mother of the Believers. She ordered that a dish called Khazirah should be prepared for us. It was then prepared. A tray containing dates was then presented to us. The narrator Qutaybah did not mention the word qina; tray. Then the Messenger of Allah ﷺ came. He asked: Has anything been served to you or ordered for you? We replied: Yes; Messenger of Allah. While we were sitting in the company of the Messenger of Allah ﷺ we suddenly saw that a shepherd was driving a herd of sheep to their fold. He had with him a newly-born lamb that was crying. He the Prophet asked him: What did it bear; O so and so? He replied: A ewe. He then said: Slaughter for us in its place a sheep. Do not think that we are slaughtering it for you. We have one hundred sheep and we do not want their number to increase. Whenever a ewe is born; we slaughter a sheep in its place. The narrator says that the Prophet ﷺ used the word la tahsabanna; do not think. I the narrator Laqit then said: Messenger of Allah; I have a wife who has something wrong in her tongue; i.e. she is insolent. He said: Then divorce her. I said: Messenger of Allah; she had company with me and I have children from her. He said: Then ask her to obey you. If there is something good in her; she will do so obey ; and do not beat your wife as you beat your slave-girl. I said: Messenger of Allah; tell me about ablution. Judge between us by the Book of Allah and give me permission to speak. He said; Speak. He said; My son was hired by this person and he committed fornication with his wife. He told me that my son deserved stoning; and I ransomed him for one hundred sheep and a slave-girl. Then I asked the people of knowledge and they told me that my son deserved to be flogged with one hundred lashes and exiled for a year; and they informed me that the woman deserved to be stoned. The Messenger of Allah; may Allah bless him and grant him peace; said; By him in whose Hand myself is; I will judge between you by the Book of Allah. As for your sheep and slave girl; they should be returned to you. Your son should have one hundred lashes and be exiled for a year. He mentioned to him that he had found a man with his wife Umar sent Abu Waqid AlLaythi to the wife to question her about that. He came to her while there were women around her and mentioned to her what her husband had mentioned to Umar Ibn AlKhattab; and informed her that she would not be punished on his word and began to suggest to her by that; that she should retract. MuwataMalik-017-001-34793Yahya related to me from Malik from Abdullah Ibn Abi Bakr Ibn Hazim that Amra bint Abdulrahman said; Aisha; the wife of the Prophet; may Allah bless him and grant him peace; went out to Makka and she had two girl mawlas of hers and a slave belonging to the sons of Abdullah Ibn Abi Bakr AlSiddiq. She sent a figured cloak with the two mawlas which was sewn up in a piece of green cloth. Amra continued; The slave took it and unstitched it and took out the cloak. In its place; he put some felt or skin and sewed it up again. When the mawla girls came to Madina; they gave it to his people. When they opened it; they found felt in it and did not find the cloak. They spoke to the two women and they spoke to Aisha; the wife of the Prophet; may Allah bless him and grant him peace; or they wrote to her and suspected the slave. The slave was asked about it and confessed. Aisha; the wife of the Prophet; may Allah bless him and grant him peace; gave the order and his hand was cut off. Aisha said; A thief hand is cut off for a quarter of a dinar and upwards. Malik said; The limit I prefer above which cutting off the hand is obliged is three dirhams; whether the exchange is high or low. That is because the Messenger of Allah; may Allah bless him and grant him peace; cut off the hand of a thief for a shield whose value was three dirhams; and Uthman Ibn Affan cut off the hand of a thief for a citron which was estimated at three dirhams. One of the two with the same mother died and left property and mawali. His full brother inherited his property and the wala of his mawali. Then he also died; and left as heirs his son and his paternal half brother. His son said; I obtain what my father inherited of property and the wala of the mawali. His brother said; It is not like that. You obtain the property. As for the wala of the mawali; it is not so. Do you think that had it been my first brother who died today; I would not have inherited from him? They argued and went to Uthman Ibn Affan. When he was dying; he said; By Allah; little daughter; there is no one I would prefer to be wealthy after I die than you. There is no one it is more difficult for me to see poor after I die than you. I gave you palm-trees whose produce is twenty awsuq. Had you cut them and taken possession of them; they would have been yours; but today they are the property of the heirs; and they are your two brothers and your two sisters; so divide it according to the Book of Allah. Aisha continued; I said; My father! By Allah; even if it had been more; I would have left it. There is only Asma. Who is my other sister? Abu Bakr replied; What is in the womb of Kharija? Kharija was the wife of Abu Bakr brother from the Ansar. When I went to the girl; my wife told me to watch out; because she had suckled her! The inheritance of a wife from a husband who does not leave children or grandchildren through sons is a quarter. If he leaves children or grandchildren through sons; male or female; the wife has an eighth after bequests and debts. That is because Allah; the Blessed; the Exalted! said in His Book; You have a half of what your wives leave if they have no children. If they have children; you have a fourth of what they leave after bequests and debts. They have a fourth of what you leave if you have no children. MuwataMalik-017-001-35137Malik said; The generally agreed on way of doing things among us about which there is no dispute and what I have seen the people of knowledge in our city doing is that when a father inherits from a son or a daughter and the deceased leaves children; or grandchildren through a son; the father has a fixed share of one sixth. If the deceased does leave any children or male grandchildren through a son; the apportioning begins with those with whom the father shares in the fixed shares. They are given their fixed shares. If a sixth or more is left over; the sixth and what is above it is given to the father; and if there is less than a sixth left; the father is given his sixth as a fixed share; i.e. the other shares are adjusted. The inheritance of a mother from her child; if her son or daughter dies and leaves children or male or female grandchildren through a son; or leaves two or more full or half siblings is a sixth. If the deceased does not leave any children or grandchildren through a son; or two or more siblings; the mother has a whole third except in two cases. One of them is if a man dies and leaves a wife and both parents. The wife has a fourth; the mother a third of what remains; which is a fourth of the capital. The other is if a wife dies and leaves a husband and both parents. The husband gets half; and the mother a third of what remains; which is a sixth of the capital. That is because Allah; the Blessed; the Exalted; says in His Book; His two parents each have a sixth of what he leaves if he has children. If he does not have children; and his parents inherit from him; his mother has a third. If he has siblings; the mother has a sixth. Surat 4 ayat 11. Malik said that if a man made any strong statement such as these to his wife; it counted as three pronouncements of divorce for a woman whose marriage had been consummated; or it was written as one of three for a woman whose marriage had not been consummated; whichever the man wished. If he said he intended only one divorce he swore to it and he became one of the suitors because; whereas a woman whose marriage had been consummated was made inaccessible by three pronouncements of divorce; the woman whose marriage had not been consummated was made inaccessible by only one pronouncement. MuwataMalik-017-001-35205Yahya related to me from Malik that he had heard that Marwan Ibn AlHakam decided about a man who had made a vow to abstain from intercourse with his wife; that when four months had passed; it was a divorce and he could return to her as long as she was in her idda. Malik added; That was also the opinion of Ibn Shihab. Malik said that if a man made a vow to abstain from intercourse with his wife and at the end of four months he declared his intent to continue to abstain; he was divorced. He could go back to his wife; but if he did not have intercourse with her before the end of her idda; he had no access to her and he could not go back to her unless he had an excuse - illness; imprisonment; or a similar excuse. His return to her maintained her as his wife. If her idda passed and then he married her after that and did not have intercourse with her until four months had passed and he declared his intent to continue to abstain; divorce was applied to him by the first vow. If four months passed; and he had not returned to her; he had no idda against her nor access because he had married her and then divorced her before touching her. Malik said that a man who made a vow to abstain from intercourse with his wife and continued to abstain after four months and so divorced her; but then returned and did not touch her and four months were completed before her idda was completed; did not have to declare his intent and divorce did not befall him. If he had intercourse with her before the end of her idda; he was entitled to her. If her idda passed before he had intercourse with her; he had no access to her. This is what Malik preferred of what he had heard on the subject. Malik said that if a man made a vow to abstain from intercourse with his wife and then divorced her; and the four months of the vow were completed before completion of the idda of the divorce; it counted as two pronouncements of divorce. If he declared his intention to continue to abstain and the idda of the divorce finished before the four months the vow of abstention was not a divorce. That was because the four months had passed and she was not his on that day. Malik said; If someone makes a vow not to have intercourse with his wife for a day or a month and then waits until more than four months have passed; it is not ila. Ila only applies to someone who vows more than four months. As for the one who vows not to have intercourse with his wife for four months or less than that; I do not think that it is ila because when the term enters into it at which it stops; he comes out of his oath and he does not have to declare his intention. Malik said; If someone vows to his wife not to have intercourse with her until her child has been weaned; that is not ila. MuwataMalik-017-001-35209Yahya related to me from Malik from Hisham Ibn Urwa that his father said that a man who pronounced a dhihar from his four wives in one statement; had only to do one kaffara. Yahya related the same as that to me from Malik from Rabia Ibn Abi Abdulrahman Malik said; That is what is done among us. Allah; the Exalted said about the kaffara for pronouncing dhihar; It is to free a slave before they touch one another. If he does not find the means to do that; then fasting for two consecutive months before they touch one another. If he cannot do that; it is to feed sixty poor people. Surat 58 ayats 4;5. Malik said that a man who pronounced dhihar from his wife on various occasions had only to do one kaffara. If he pronounced dhihar; and then did kaffara; and then pronounced dhihar after he had done the kaffara; he had to do kaffara again. Malik said; Some one who pronounces dhihar from his wife and then has intercourse with her before he has done kaffara; only has to do one kaffara. He must abstain from her until he does kaffara and ask forgiveness of Allah. That is the best of what I have heard. Malik said; It is the same with dhihar using any prohibited relations of fosterage and ancestry. Malik said; Women have no dhihar. Malik said that he had heard that the commentary on the word of Allah; the Blessed; the Exalted; Those of you who pronounce the dhihar about their wives; and then retract what they have said; Surat 56 ayat 3 ; was that a man pronounced dhihar on his wife and then decided to keep her and have intercourse with her. If he decided on that; he must do kaffara. If he divorced her and did not decide to retract his dhihar of her and to keep her and have intercourse with her; there would be no kaffara incumbent on him. Maliksaid; If he marries her after that; he does not touch her until he has completed the kaffara of pronouncing dhihar. Malik said that if a man who pronounced dhihar from his slave-girl wanted to have intercourse with her; he had to do the kaffara of the dhihar before he could sleep with her. Then she was set free and she sent a message to Hafsa; the wife of the Prophet; may Allah bless him and grant him peace. Hafsa called her and said; I will tell you something.; but I would prefer that you did not act upon it. You have authority over yourself as long as your husband does not have intercourse with you. If he has intercourse with you; you have no authority at all. Malik added; That is the best of what I have heard. Malik said that if a woman who had been given the right of choice by her husband chose herself; she was divorced trebly. If her husband said; But I only gave her the right of choice in one; he had none of that. That was the best of what he had heard. What do you think a man who finds another man with his wife should do? Should he kill him and then be killed himself; or what should.he do? Aasi m! ask the Messenger of Allah; may Allah bless him and grant him peace; about that for me. Aasi m asked the Messenger of Allah; may Allah bless him and grant him peace; about it. The Messenger of Allah; may Allah bless him and grant him peace; was revolted by the questions and reproved them until what he heard from the Messenger of Allah; may Allah bless him and grant him peace. was intolerable for Aasi m. When Aasi m returned to his people; Uwaymir came to him and said; Aasi m! what did the Messenger of Allah; may Allah bless him and grant him peace; say to you? Aasi m said to Uwaymir; You didnt bring me any good. The Messenger of Allah; may Allah bless him and grant him peace; was revolted by the question which I asked him. Uwaymir said; By Allah! I will not stop until I ask him about it! Uwaymir stood up and went to the Messenger of Allah; may Allah bless him and grant him peace; in the middle of the people and said; Messenger of Allah! What do you think a man who finds another man with his wife should do? Should he kill him and then be killed himself; or what should he do? The Messenger of Allah; may Allah bless him and grant him peace; said; Something has been sent down about you and your wife; so go and bring her. Sahl continued; They mutually cursed one another in the presence of the Messenger; may Allah bless him and grant him peace; and I was present with the people. When they finished cursing each other; Uwaymir said; I shall have lied about her; Messenger of Allah; if I keep her; and pronounced the divorce three times before the Messenger of Allah; may Allah bless him and grant him peace; ordered him to do it. MuwataMalik-017-001-35223Yahya related to me from Malik from Nafic from Abdullah Ibn Umar that a man cursed his wife in the time of the Messenger of Allah; may Allah bless him and grant him peace; and disowned her child. The Messenger of Allah; may Allah bless him and grant him peace; separated them and gave the child to the woman. Malik said; Allah the Blessed; the Exalted; said; The testimony of men who accuse their wives but do not have any witnesses except themselves is to testify by Allah four times that he is being truthful; and a fifth time; that the curse of Allah will be upon him; if he should be a liar. She will avoid punishment if she testifies by Allah four times that he is a liar; and a fifth time; that the wrath of Allah shall be upon her; if he should be telling the truth. Surat 24 ayat 6. Malik said; The sunna with us is that those who curse each other are never to be remarried. If the man calls himself a liar; i.e. takes back his accusation ; he is flogged with the hadd-punishment; and the child is given to him; and his wife can never return to him. There is no doubt or dispute about this sunna among us. Malik said; If a man separates from his wife by an irrevocable divorce by which he cannot return to her; and then he denies the paternity of the child she is carrying; whilst she claims that he is the father; and it is possible by the timing; that he be so; he must curse her; and the child is not recognised as his. Malik said; That is what is done among us; and it is what I have heard from the people of knowledge. Malik said that a man who accused his wife after he had divorced her trebly while she was pregnant; and he had at first accepted being the father but then claimed that he had seen her committing adultery before he separated from her; was flogged with the hadd-punishment; and did not curse her. If he denied the paternity of her child after he had divorced her trebly; and he had not previously accepted it; then he cursed her. Malik said; This is what I have heard. Malik said; The slave is in the same position as the free man as regards making accusations and invoking mutual curses lian. He acts in the lian as the free man acts although there is no hadd applied for slandering a female-slave. Malik said; The muslim slave-girl and the christian and jewish free woman also do lian when a free muslim marries one of them and has intercourse with her. That is because Allah - may He be blessed and Exalted; said in His Book; As for those who accuse their wives; and they are their wives. This is what is done among us. Malik said that a man who did the lian with his wife; and then stopped and called himself a liar after one or two oaths and he had not cursed himself in the fifth one; had to be flogged with the hadd-punishment; but they did not have to be separated. Malik said that if a man divorced his wife and then after three months the woman said; I am pregnant; and he denied paternity; then he had to do lian. Malik said that the husband of a female slave who pronounced the lian on her and then bought her; was not to have intercourse with her; even if he owned her. The sunna which had been handed down about a couple who mutually cursed each other in the lian was that they were never to return to each other. MuwataMalik-017-001-35236Yahya related to me from Malik from Abuz-Zinad from Sulayman Ibn Yasar that Nufay; a mukatab of Umm Salamah the wife of the Prophet; may Allah bless him and grant him peace; or her slave; had a free woman as a wife. He divorced her twice; and then he wanted to return to her. The wives of the Prophet; may Allah bless him and grant him peace; ordered him to go to Uthman Ibn Affan to ask him about it. He found him at AlDaraj with Zayd Ibn Thabit. He asked them; and they both anticipated him and said; She is haram for you.
