SahihAlBukhari-017-001-6386Narrated Malik Bin Aus AlHadathan AlNasri: That once Umar Bin AlKhattab called him and while he was sitting with him; his gatekeeper; Yarfa came and said; Will you admit Uthman; Abdulrahman Bin Auf; AlZubair and Saad bin Abi Waqqas who are waiting for your permission? Umar said; Yes; let them come in. After a while; Yarfa- came again and said; Will you admit Ali and Abbas who are asking your permission? Umar said; Yes. So; when the two entered; Abbas said; O chief of the believers! Judge between me and this i.e. Ali. Both of them had a dispute regarding the property of Bani AlNadir which Allah had given to His Apostle as Fai i.e. booty gained without fighting ; Ali and Abbas started reproaching each other. The present people i.e. Uthman and his companions said; O chief of the believers! Give your verdict in their case and relieve each from the other. Umar said; Wait I beseech you; by Allah; by Whose Permission both the heaven and the earth stand fast! Do you know that Allah Messenger ﷺ said; We Prophets our properties are not to be inherited; and whatever we leave; is to be spent in charity; and he said it about himself? They i.e. Uthman and his company said; He did say it. Umar then turned towards Ali and Abbas and said; I beseech you both; by Allah! Do you know that Allah Messenger ﷺ said this? They replied in the affirmative. He said; Now I am talking to you about this matter. Allah the Glorified favored His Apostle with something of this Fai i.e. booty won without fighting which He did not give to anybody else. Allah said:- And what Allah gave to His Apostle Fai Booty from them-For which you made no expedition With either Calvary or camelry. But Allah gives power to His Apostles Over whomsoever He will And Allah is able to do all things. 59.6 So this property was especially granted to Allah Messenger ﷺ. But by Allah; the Prophet ﷺ neither took it all for himself only; nor deprived you of it; but he gave it to all of you and distributed it amongst you till only this remained out of it. And from this Allah Messenger ﷺ used to spend the yearly maintenance for his family; and whatever used to remain; he used to spend it where Allah Property is spent i.e. in charity ; Allah Messenger ﷺ kept on acting like that during all his life; Then he died; and Abu Bakr said; I am the successor of Allah Messenger ﷺ. So he i.e. Abu Bakr took charge of this property and disposed of it in the same manner as Allah Messenger ﷺ used to do; and all of you at that time knew all about it. Then Umar turned towards Ali and Abbas and said; You both remember that Abu Bakr disposed of it in the way you have described and Allah knows that; in that matter; he was sincere; pious; rightly guided and the follower of the right. Then Allah caused Abu Bakr to die and I said; I am the successor of Allah Messenger ﷺ and Abu Bakr. So I kept this property in my possession for the first two years of my rule i.e. Caliphate and I used to dispose of it in the same wa as Allah Messenger ﷺ and Abu Bakr used to do; and Allah knows that I have been sincere; pious; rightly guided an the follower of the right in this matte Later on both of you i.e. Ali and Abbas came to me; and the claim of you both was one and the same; O Abbas! You also came to me. So I told you both that Allah Messenger ﷺ said; Our property is not inherited; but whatever we leave is to be given in charity. Then when I thought that I should better hand over this property to you both or the condition that you will promise and pledge before Allah that you will dispose it off in the same way as Allah Messenger ﷺ and Abu Bakr did and as I have done since the beginning of my caliphate or else you should not speak to me about it. So; both of you said to me; Hand it over to us on this condition. And on this condition I handed it over to you. Do you want me now to give a decision other than that decision ? By Allah; with Whose Permission both the sky and the earth stand fast; I will never give any decision other than that decision till the Last Hour is established. But if you are unable to manage it i.e. that property ; then return it to me; and I will manage on your behalf. The sub-narrator said; I told Urwa Bin AlZubair of this Hadith and he said; Malik Bin Aus has told the truth I heard Aisha; the wife of the Prophet ﷺ saying; The wives of the Prophet ﷺ sent Uthman to Abu Bakr demanding from him their 1/8 of the Fai which Allah had granted to his Apostle. But I used to oppose them and say to them: Will you not fear Allah? Dont you know that the Prophet used to say: Our property is not inherited; but whatever we leave is to be given in charity? The Prophet ﷺ mentioned that regarding himself. He added: The family of Muhammad can take their sustenance from this property. So the wives of the Prophet ﷺ stopped demanding it when I told them of that. So; this property of Sadaqa was in the hands of Ali who withheld it from Abbas and overpowered him. SahihAlBukhari-017-001-6582Narrated Aisha: Fatima the daughter of the Prophet ﷺ sent someone to Abu Bakr when he was a caliph ; asking for her inheritance of what Allah Messenger ﷺ had left of the property bestowed on him by Allah from the Fai i.e. booty gained without fighting in Medina; and Fadak; and what remained of the Khumus of the Khaibar booty. On that; Abu Bakr said; Allah Messenger ﷺ said; Our property is not inherited. Whatever we leave; is Sadaqa; but the family of the Prophet Muhammad can eat of this property. By Allah; I will not make any change in the state of the Sadaqa of Allah Messenger ﷺ and will leave it as it was during the lifetime of Allah Messenger ﷺ ; and will dispose of it as Allah Messenger ﷺ used to do. So Abu Bakr refused to give anything of that to Fatima. So she became angry with Abu Bakr and kept away from him; and did not task to him till she died. She remained alive for six months after the death of the Prophet. When she died; her husband Ali; buried her at night without informing Abu Bakr and he said the funeral prayer by himself. When Fatima was alive; the people used to respect Ali much; but after her death; Ali noticed a change in the people attitude towards him. So Ali sought reconciliation with Abu Bakr and gave him an oath of allegiance. Ali had not given the oath of allegiance during those months i.e. the period between the Prophet death and Fatima death. Ali sent someone to Abu Bakr saying; Come to us; but let nobody come with you; as he disliked that Umar should come; Umar said to Abu Bakr ; No; by Allah; you shall not enter upon them alone Abu Bakr said; What do you think they will do to me? By Allah; I will go to them So Abu Bakr entered upon them; and then Ali uttered Tashah-hud and said to Abu Bakr ; We know well your superiority and what Allah has given you; and we are not jealous of the good what Allah has bestowed upon you; but you did not consult us in the question of the rule and we thought that we have got a right in it because of our near relationship to Allah Messenger ﷺ. Thereupon Abu Bakr eyes flowed with tears. And when Abu Bakr spoke; he said; By Him in Whose Hand my soul is to keep good relations with the relatives of Allah Messenger ﷺ is dearer to me than to keep good relations with my own relatives. But as for the trouble which arose between me and you about his property; I will do my best to spend it according to what is good; and will not leave any rule or regulation which I saw Allah Messenger ﷺ following; in disposing of it; but I will follow. On that Ali said to Abu Bakr; I promise to give you the oath of allegiance in this after noon. So when Abu Bakr had offered the Zuhr prayer; he ascended the pulpit and uttered the Tashah-hud and then mentioned the story of Ali and his failure to give the oath of allegiance; and excused him; accepting what excuses he had offered; Then Ali got up and praying to Allah for forgiveness; he uttered Tashah-hud; praised Abu Bakr right; and said; that he had not done what he had done because of jealousy of Abu Bakr or as a protest of that Allah had favored him with. Ali added; But we used to consider that we too had some right in this affair of rulership and that he i.e. Abu Bakr did not consult us in this matter; and therefore caused us to feel sorry. On that all the Muslims became happy and said; You have done the right thing. SahihAlBukhari-017-001-6868Narrated Anas Bin Malik: Out of all the Ansar; living in Medina; Abu Talha had the largest number of date palm trees gardens; and the most beloved of his property to him was Bairuha garden which was standing opposite the Masjid of the Prophet. Allah Messenger ﷺ used to enter it and drink of its good water. When the Verse:-By no means shall you attain righteousness unless you spend in charity of that which you love. 3.92 Abu Talha got up and said; O Allah Messenger ﷺ ; Allah says:-By no means shall you attain righteousness unless you spend in charity of that which you love. 3.92 and the most beloved of my property to me is the Bairuha garden; so I give it as a charitable gift in Allah Cause and hope to receive good out of it; and to have it stored for me with Allah. So; O Allah Messenger ﷺ ! Dispose it of i.e. utilize it in the way Allah orders you to dispose it of. Allah Messenger ﷺ said; Bravo! That is a fruitful property! That is a fruitful property! I have heard what you have said and I think that you should distribute that garden amongst your relatives. SunanAlNasai-017-001-13819It was narrated that Malik Bin Aws Bin AlHadathan said: AlAbbas and Ali came to Umar with a dispute. AlAbbas said: Pass judgment between him and I. the people said: Pass judgment between them. Umar said: I will not pass judgment between them. They know that the Messenger of Allah said: We are not inherited from; what we leave behind is charity. He said: And in this narration of it AlZuhri said: It the Khumus was under the control of the Messenger of Allah ; and he took provision for himself and for his family from it; and disposed to the rest of it as he disposed of other wealth belonging to the Muslims. Then Abu Bakr took control of it; then I took control of it after Abu Bakr; and I did with it what he sued to do. Then these two came to me and asked me to give it to them so that they could dispose of it as the Messenger of Allah disposed of it; and as Abu Bakr disposed of it; and as I disposed of it. So I gave it to them and I took promises from them that they would take proper care of it. Then they came to me and this one said. Give me my share from my brothers son: and this one said: Give me my share from my wife. If they want me to give it to them on the condition that they would dispose of it in the same manner as the Messenger of Allah did; and as Abu Bakr did; and as I did; I would give it to them; but if they refuse; then they do not have to worry about it. Then he said: And know that whatever of spoils of war that you may gain; verily; one-fifth of it is assigned to Allah; and to the Messenger; and to the near relatives of the Messenger Muhammad ; and also the orphans; AlMasakin the poor and the wayfarer AlAnfal 8:41 this if for them. AlSadaqat here it means Zakah are only for the Fuqara poor ; and AlMasakin the poor and those employed to collect the funds ; and to attract the hearts of those who have been inclined toward Islam ; and to free the captives; and for those in debt; and for Allah cause I.e. for Mujahidun - those fighting in a holy battle - this is for them. And what Allah gave as booty Fay to His Messenger Muhammad from them - for this you made no expeditin with either cavalry or camels. AlZuhri said: This applies exclusively to the Messenger of Allah and refers to an Arab village called Fadak; and so on. What Allah gave as booty Fay to His Messenger Muhammad from the people of the townships - it is for Allah; His Messenger Muhammad ; the kindred of Messenger Muhammad ; the orphans; AlMasakin the poor ; and the wayfarer And there is also a share in this booty for the poor emigrants; who were expelled from their homes and their property And it is also for those who; before them; had homes in AlMadinah and had adopted the Faith And those who came after them. These is no one left among the Muslims but he has some rights to this wealth; except for some of the slaved whom you own. If I live; if Allah wills; I will give every Muslim his right. MuwataMalik-017-001-34889Yahya said that he heard Malik say; The best of what I have heard about the testament of a pregnant woman and about what settlements she is permitted in her property is that the pregnant woman is like the sick person. When the illness is light; and one does not fear for the sick person; he does with his property what he likes. If the illness is such that his life is feared for; he can only dispose of a third of his estate. He said; It is the same with a woman who is pregnant. The beginning of pregnancy is good news and joy. It is not illness and no fear because Allah the Blessed; the Exalted; said in His Book; We gave her good news of Ishaq and after Ishaq; Yaqub. Surat ll ayat 71. And He said; She bore a light burden and passed by with it; but when she became heavy; they called upon Allah; their Lord; If you give us a good-doing son; we will be among the thankful. Surat 7 ayat 189. When a pregnant woman becomes heavy; she is only permitted to dispose of a third of her estate. The beginning of this restriction is after six months. Allah; the Blessed; the Exalted; said in His Book; Mothers suckle their children for two complete years. And He said; his bearing and weaning are thirty months. Surat 2 ayat 233. When six months have passed for the pregnant woman from the day she conceived; she is only permitted to dispose of a third of her property. Yahya said that he heard Malik say; A man who is advancing in the row for battle; can only dispose of a third of his property. MuwataMalik-017-001-35524Yahya related to me from Malik that he had heard that Said Ibn AlMusayab was asked whether a man who had vowed to fast a month could fast voluntarily; and Said said; He should fulfil his vow before he does any voluntary fasting. Malik said; I have heard the same thing from Sulayman Ibn Yasar. Malik said; If someone dies with an unfulfilled vow to free a slave or to fast or to give sadaqa or to give away a camel; and makes a bequest that his vow should be fulfilled from his estate; then the sadaqa or the gift of the camel are taken from one third of his estate. Preference is given to it over other bequests; except things of a similar nature; because by his vow it has become incumbent on him; and this is not the case with something he donates voluntarily. They vows and voluntary donations are settled from a limited one-third of his estate; and not from the whole of it; since if the dying man were free to dispose of all of his estate; he might delay settling what had become incumbent on him i.e. his vows ; so that when death came and the estate passed into the hands of his heirs; he would have bequeathed such things i.e. his vows that were not claimed by anyone like debts. If that i.e. to dispose freely of his property were allowed him; he would delay these things i.e. his vows until when he was near death; he would designate them and they might take up all of his estate.
